What specifically was the special council's job to investigate when it started out?

(i) any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump; and

(ii) any matters that arose or may arise directly from the investigation; and

I can't imagine being so upset that someone told me I was wrong that I would go back to their old posts for 5 months after I believed they had left a forum to give them fake digital negative reputation every few weeks- and to keep having a one sided conversation with them.

I can't imagine being so upset that someone told me I was wrong that I would go back to their old posts for 5 months after I believed they had left a forum to give them fake digital negative reputation every few weeks- and to keep having a one sided conversation with them.

That would seem to suggest that they're at least considering accepting (honestly, at this point they may just figure that waiting for a subpoena would make the press around this much, much worse). It would also seem to suggest that the last meeting with Mueller has changed the equation a bit. (Which would also explain why Dowd left around that time)


One source familiar with the proceedings stressed the preparation efforts is "in its infancy."
The preparations have been short and informal and included going over potential topics with the President that Mueller would likely raise in an interview, the people said.

Joseph Schmitz approached the FBI and other government agencies about material a client of his had discovered that Schmitz believed might have been Clinton's missing 30,000 emails from her private e-mail server, sources say. The material was never verified, and sources say they ultimately believed it was fake.

His push is the latest example of Trump advisers who were mixed up in efforts to find dirt on Clinton during the presidential campaign. Schmitz was one of the first people Trump named to his campaign's national security and foreign policy team. The team, showcased in a March 2016 photo, was thrown together early in Trump's successful run as he faced mounting pressure to prove his ability to pull in high-level advisers who could help prepare him for the White House.

Another adviser pictured in the photo, Trump's foreign policy adviser George Papadopoulos, was told by a Kremlin-connected professor that the Russian government had damaging material on Clinton. Six weeks later, Donald Trump Jr. got a message from a business associate offering similar information, leading to the Trump Tower meeting that Trump's son-in-law Jared Kushner and then-campaign chairman Paul Manafort attended.

Fired chief strategist Steve Bannon told the House Intelligence Committee in February that members of the Trump campaign "kept getting approached" by outsiders suggesting ways to get Clinton's emails, according to a source familiar with his testimony.

He's responsible for one of the freedom to discrimination/freedom of religion bills. Her sister called her up sobbing, terrified of what this is going to mean for her. I broke down too- what does this mean for my other brother who happens to be gay?


Anyone in our situation would worry. We'd be insane not to.


I feel so useless.


This is what life is now I guess. Scared one brother is going to be deported, scared another brother is going to lose his rights, and wondering how much it's going to cost me to cover insurance for two siblings who are going to lose it otherwise.


These are the human consequences of the election. No amount of dismissal, sarcasm, or heartless amusement will change the reality of it for families like mine.


Do me a favor- don't act like the horrible situation we're in is somehow inevitable. You can dismiss the pain, you can act like a fun overseas romp of your own volition is akin to the fear of having your family ripped apart to placate the masses, and you can hypocritically mansplain to me about sacrifices you will never understand.

Former Trump campaign chairman Paul Manafort filed a motion late Friday to suppress evidence special counsel Robert Mueller’s team found in a storage locker in Virginia.

Manafort is claiming that Mueller unlawfully had access to the business records in the unit because a former Manafort employer listed on the lease allowed entry. According to Manafort, the employee didn’t have the authority to allow a FBI agent into the unit.

During that visit, agent didn’t seize any records but “entered and observed a number of boxes and a filing cabinet inside the premises, as well as some writing on the sides of some boxes,” according to the filing.


The agent wrote and signed an affidavit in favor of a search of the storage unit the next day, in May 2017, using “information he had obtained during his warrantless search” to argue in favor of a warrant to search and seize documents from the unit, the court documents state.

This appears to have been part of the flurry of subpoenas that Mueller's team got shortly after flipping Gates.

Manafort's legal strategy continues to perplex. He's fighting against a waterfall with a toy bucket.

Though if you look at this as a non-legal, legal strategy it starts to make some sense. He's not trying to win this case- he's stalling.

My best guess on this one is that Manafort does have the closet of smoking guns that Mueller thinks he has (maybe for collusion, or maybe just something unrelated entirely), and he knows that Trump is aware of that fact. He's waiting for Mueller to overplay his hand- get all of the charges out in Federal Court, and then he's counting on Trump for a pardon. Trump can't pardon him too early- any charges that are left off the table can (and will) be picked right back up by the NY AG.

Yes technically it's up to Rosenstein but from what I gather Mueller could force his hand. If he were to recommend charges against Trump that weren't allowed, Rosenstein would be required to brief Congress.

I don't believe that for a minute. Information on the investigation will be strategically released to maximize every opportunity to diminish support for the GOP during the midterm elections.

Well I'm furious with what the GOP has done so far but I don't put blame on Trump. I think Ryan and McConnell need to go. That said, tax cuts are in effect (which is positive) and hopefully most Americans won't be affected by the next recession to hit (later this year or early 2019).

The recent poll for Corker's seat has added a glimmer of hope for the Dems. Also, there's an increasing chance that McCain will end up retiring, and AZ is definitely in purple territory right now. Add to that the fact that the GOP nominee in West Virginia may be that crazy guy who just got out of jail, and you've got a moonshot chance here.

None of these are things I would take to the bank- the Dems are still going to be lucky to break even. But...things are shifting pretty rapidly right now.

A Mueller report pre-election in either direction is likely to energize the GOP base though. That's a potentially significant X factor that no one is really accounting for right now.

I think people are sick of the crap. California is the poverty capital of the nation. There's a good chance a Republican governor will be elected this year.

I think a lot of people are seeing that liberal policies bring disaster and don't work. Perhaps they may not see themselves as Republicans but they may vote that way to get something new/different.

I don't think Dem messaging is inherently problematic. I think that when there's someone like Trump in office- it sucks up all of the oxygen in the room.

When you're the minority party, it's already really hard to get any air time for your message, and when you add in an orange scandal machine- it just compounds the effect.

You know, I think we all have fundamentally understood that you have had some emotional issues that you've been working through on these forums for years. But, tonight is actually the first time I realized- you actually can't help yourself. I don't mean that in an accusing way- I mean that in a very sincere, apologetic, way.

I'm writing to a grown man who is typing in all caps and saying things like, "You still have that persistent diarrhea from HiV?", who has currently picked a fight with no fewer than 4 people in a thread because they said something he didn't agree with, and who is accusing everyone around him of being out of control- while posting 12-15 times an hour.

And he's doing it in a forum for a game he hasn't played in years. A forum with a rep system that he has spent an inordinate amount of time learning to manipulate in order to punish people who make him feel lesser in any way- less intelligent, less knowledgeable, less reasonable, less successful, etc.


And this grown man finds these slights- intentional or not- from complete strangers to be so painful that the punishment lasts for months- even after he thinks someone is gone. It enrages him, and he cannot help himself after that. He has to "even the score", prove to himself that these other people who make him feel lesser are actually the ones who are lesser. That doesn't make you a bad person. It just makes you ill. And that means that pushing back on you is actually the equivalent of judging someone who is autistic for not making eye contact. It's cruel.

And for my part, I'm sorry. I hope that you do get some help at some point, or, at least, that this forum provides you with the outlet you need to keep yourself from pouring this rage and pain into your real relationships. And I will do my best to stop putting you in positions that trigger a compulsive set of behaviors that you can't control.

Because I'm realizing tonight that your behavior isn't unfair towards others- it's an unfair reality you're forced to live with.

And I would encourage others to recognize the same and to treat you with some more compassion.

Well I'm furious with what the GOP has done so far but I don't put blame on Trump. I think Ryan and McConnell need to go. That said, tax cuts are in effect (which is positive) and hopefully most Americans won't be affected by the next recession to hit (later this year or early 2019).

I'm writing to a grown man who is typing in all caps and saying things like, "You still have that persistent diarrhea from HiV?", who has currently picked a fight with no fewer than 4 people in a thread because they said something he didn't agree with, and who is accusing everyone around him of being out of control- while posting 12-15 times an hour.

And he's doing it in a forum for a game he hasn't played in years. A forum with a rep system that he has spent an inordinate amount of time learning to manipulate in order to punish people who make him feel lesser in any way- less intelligent, less knowledgeable, less reasonable, less successful, etc.


And this grown man finds these slights- intentional or not- from complete strangers to be so painful that the punishment lasts for months- even after he thinks someone is gone. It enrages him, and he cannot help himself after that. He has to "even the score", prove to himself that these other people who make him feel lesser are actually the ones who are lesser. That doesn't make you a bad person. It just makes you ill. And that means that pushing back on you is actually the equivalent of judging someone who is autistic for not making eye contact. It's cruel.

And for my part, I'm sorry. I hope that you do get some help at some point, or, at least, that this forum provides you with the outlet you need to keep yourself from pouring this rage and pain into your real relationships. And I will do my best to stop putting you in positions that trigger a compulsive set of behaviors that you can't control.

Because I'm realizing tonight that your behavior isn't unfair towards others- it's an unfair reality you're forced to live with.

And I would encourage others to recognize the same and to treat you with some more compassion.

Sounds like you are renting based on your comments. I wouldn't be buying at this time if it were me but Denver has a lot of good things going for it. Who knows if it really is at the peak - local markets are so different.

It's sort of a seller's market currently, but the interest rates will be going up. If you can lock in a low interest rate now, you will end up saving money in the long run.. even if you are buying at the top end of the property value.

Good advice...assuming you'll keep your home for awhile. I don't think this upcoming recession is all that big of a deal (not 2008). The one I am worried about is around 2030 with the way demographic trends are heading. Make sure you completely own your home by then.

Yeah, he has a very slim chance of this actually working as a legal argument.

It could well work as a political narrative though. He's basically trying to play off of the whole FBI/Deep State/Abuse of Power thing that Trump's defenders have been trying to create. At this point in time, Manafort's best chance of living life outside of prison is to hope that narrative takes hold- freeing Trump to pardon him.

Mueller is no fool though. I'm increasingly convinced that his early obstruction report is his check mate move. If Mueller lays out a pattern of behavior consistent with obstruction of justice in his report, Manafort will flip shortly after. If not, Trump will be emboldened to shut the investigation down, and he'll pardon Manafort (and anyone else he wants).

Special counsel Robert Mueller was appointed by the Justice Department to run the election probe and has been scrutinizing connections between Cambridge Analytica and Trump's Republican campaign.



Honestly, if they need him to provide evidence that the Trump campaign misused that data then this is going to be a tough climb. He needs someone else to whistleblow with some hard evidence at this point, and Wylie has been clear that he doesn't have it.

Though it's always possible Bannon will cooperate and provide testimony for it- which means they would use Wylie as a corroborating witness.

There's an equal possibility that the data wasn't used for the Trump campaign, or that what they did isn't actually illegal. The case law for the Computer Fraud and Abuse Act is really fuzzy on this, and honestly there are very good reasons not to try to convince the Courts to apply the CFAA to civilian situations like this. (Or suddenly sharing passwords is potentially a felony). This is REALLY not my area though- so there may be other laws that could more clearly apply to this situation that I'm not aware of.

So LawFare did a great piece (https://www.lawfareblog.com/can-mueller-or-rosenstein-issue-interim-report-obstruction) on how exactly Mueller might be allowed to write an interim obstruction report, and how Rosenstein might be able to release it. They basically conclude that there are legal possibilities, but that none of them are especially airtight. They (rightly) point out that if this isn't all done 100% by the book, it will immediately be open to criticism. If it exonerates Trump, then it looks suspiciously like they were pressured to bend the rules to let the public know that. If it doesn't exonerate Trump, it starts playing into the Deep State hysteria.

Most of what I've seen out there seems to focus on 8 USC § 600.8 (https://www.law.cornell.edu/cfr/text/28/600.8) and 8 USC § 600.9 (https://www.law.cornell.edu/cfr/text/28/600.9)- both of which are definitely open to some loose interpretation allowing for the public release of an interim report, but honestly, focusing there falls into the aforementioned trap. If they do decide to go with 8 USC § 600.8a(2) [which requires Mueller to give Rosenstein a full update of the investigation along with his annual budget request], then the report will be issued to Rosenstein July 1st.

But it seems that there are actually two less talked about ways for Rosenstein and Mueller to make this interim report happen:

The first:
I haven't seen anyone discussing this anywhere, so it's quite possible that I'm just misunderstanding the context of the statute. But technically 28 USC § 600.7(b) (https://www.law.cornell.edu/cfr/text/28/600.7) allows Rosenstein to "request that the Special Counsel provide an explanation for any investigative or prosecutorial step". That would undoubtedly include the decision to shut down a part of the investigation.

From there, 8 USC § 600.9(c) allows for the release of "other releases of information" [aside from the appointment or dismissal or Mueller as well as the conclusion of Mueller's work] as long as it's in compliance with USAM Chapter 1-7.000 (https://www.justice.gov/usam/usam-1-7000-media-relations). The thing about that section is that it repeatedly, and expressly gives the Assistant AG the ability to approve public disclosure of information that wouldn't normally be allowed under the guidelines. Whereas Comey (loosely) used USAM Chapter 1-7.400(c) to essentially go rogue and hold a press conference without Lynch's approval, Rosenstein technically doesn't need a justification. Though the aforementioned statute as well as USAM Chapter 1-7.500(d) both technically allow for a public release of Mueller's findings.

The Second:

So this one is sort of interesting. For those who don't know, Mueller wasn't technically appointed through the Special Counsel provisions (https://www.justice.gov/opa/press-release/file/967231/download), he was appointed through 28 U.S.C. §§ 509, 510, and 515. (He did end up saying that most of the Special Counsel provision does apply to Mueller though) He's able to do so because in regards to the Russia and Obstruction investigations, he is effectively the acting Attorney General. And he's the Acting Attorney General for only these investigations. (or singular investigation- that part still remains murky) 28 U.S.C. § 529 (https://www.law.cornell.edu/uscode/text/28/529) actually requires the Attorney General to submit an annual report to Congress every June 1st. That report includes "any violation of Federal criminal law by any individual who holds or who at the time of such violation held a position, whether or not elective, as a Federal Government officer, employee, or special employee, if such violation relates directly or indirectly to such individual’s Federal Government position, employment, or compensation".

There's also a catch-all for "anything else deemed appropriate". Arguably, in his capacity of Acting AG for Mueller's investigation, you could interpret the statue as requiring Rosenstein to update Congress on the investigation. Now there's a provision in there that precludes sharing information that would " disclose information which would interfere with any pending investigation or prosecution" [emphasis mine]. If Mueller has closed out the obstruction investigation by June 1st, then Rosenstein would only have to issue a report on that piece of the investigation (since the Russia/Collusion investigation is still ongoing). So that's another way to get the information out- though I'm skeptical of this timeline since Trump hasn't agreed to an interview yet.

Frankly, if Trump's lawyers are smart they'll delay the interview until after July 1st.

Both methods seem a little unorthodox- let me know if anyone has any information that would back up or break down either of these options.

Wow. Seems like this probably came as a result of the recent Trump Org subpoena.

I wonder if Mueller is trying to get him to flip? Given Cohen was involved in the Trump Moscow deal, and he shows up in the dossier- I have a hard time believing Mueller's team doesn't care what happens next. I'm guessing he had to refer this to another division because what they found probably doesn't directly relate to his mandate.

Cohen isn't going to agree to be a cooperative witness unless he gets something out of it. He could just plead the 5th all day long. This raid was done dramatically and in broad daylight for a reason- they're trying to pressure him into cooperating.

Risky Political Prediction Time. We're getting to that point where we can start issuing our risky (i.e. based on woefully incomplete information) predictions.

What's your risky prediction about the investigation?

There are a lot of assumptions being made in this prediction, so there's a LOT of room for error. But here's my risky prediction:

1) Mueller has determined that DoJ guidelines prevent him from indicting a sitting President. He will issue a factual obstruction report without any direct conclusions but which clearly, implicitly leads to one conclusion: that Trump obstructed justice. The report will include some discussion of the fact that DoJ guidelines prevent indictment of a sitting President.

2) There will be no charges related to Russia/Collusion against Manafort or any of Trump's family until after the obstruction report comes out. Mueller is well aware of Trump's Pardon power- which is why the charges against Flynn, Mueller, and Gates have all been for financial crimes and lying to the FBI. Pardoning them for these crimes would look terrible.

3) Manafort is using every legal strategy in the book to stall his cases right now because he's waiting for a Trump Pardon. Trump is waiting until Mueller's office adds Russia/Collusion charges to his indictments before issuing a Pardon. The plan is to argue that since this is a "politically motivated witch hunt", they are bogus charges- though Mueller's financial crimes indictments seriously- and intentionally- undercut any arguments that Manafort is somehow an "innocent victim" in all of this.

3) The obstruction report will come out this summer and will mention the fact that Trump had Dowd offer a pardon to Manafort and Flynn as an example of Federal witness tampering (which is one of the classic examples of obstruction). Once he has listed that as an example of Trump's obstruction, it becomes politically very dangerous to start issuing Pardons to people who are serious targets in the investigation, and Mueller has actually made it legally dangerous at that point too.

4) Realizing he's not going to get a Pardon, Manafort will immediately flip and provide damning evidence against someone or someoneS of consequence in the Russia/Collusion investigation.

5) Then the Russia/Collusion-related indictments will start coming out



It would explain the following-
-Why Gates and Flynn both got the plea deal of a lifetime (you don't get that unless you have something of very high value to offer- given the severity of their potential crimes)
-Why Manafort refuses to work out a plea deal with Mueller
-Why Mueller is planning on issuing a separate obstruction report relatively quickly (according to reporting anyway)
-Why Mueller is planning on issuing an interim report at all
-Why there are no indictments directly related to Russia/Collusion as of yet (except against Russian nationals)



Big Risks-

-Mueller may very well decide after interviewing Trump that he can't prove corrupt intent

-Mueller may actually be releasing an early "interim" report because the obstruction investigation was actually a separate investigation from Russia/Collusion. Meaning it's not actually an interim report at all

-Trump may decide to fire Mueller instead of interviewing with him, or he may decide to preemptively Pardon Manafort (though it would look terrible to give a blanket Pardon to anything related to illegal activity involving Russia/Collusion activities without having specific allegations to argue against)

-Reporting may be inaccurate on a number of fronts- including the interim report, the Gates plea deal, Manafort waiting for a Pardon, Dowd having dangled a Pardon in front of Flynn and Manafort, etc.

-Manafort may genuinely be holding out because he has no information on Russia/Collusion to offer. (Though this is made less likely by the reporting on the terms of Gates's plea deal)

Hopefully trump tries to fire rosenstein over this. Rosenstein did go to the FBI in regards to Cohen after muellers recommendation.

Also, the funny thing is, so many trump supporters are cool with him being a criminal as long as he didn’t conspire with Russia. So much more will come out.

Here's an interesting comment I found.


As a lawyer of 35 years, this is one of the most significant developments in the Mueller investigation.

It is extraordinarily hard to convince a judge, who is a former lawyer himself or herself, to pierce the attorney/client privilege and work product doctrine to issue a subpoena and seize material subject to those sacred protections.


The judge must be convinced that Cohen's records will demonstrate substantial criminal activity.

I do agree with some of the other assessments here though- Trump's liable to start getting impulsive soon. That means that either he'll rush into an interview to "prove" his innocence (and to separate himself from Cohen), or he's going to do something drastic like force Sessions to resign. If Sessions resigns, Trump can install someone in his place temporarily without having to go through Senate confirmation.

Though Mueller and Rosenstein were VERY smart to refer this out to the FBI. It insulates them from direct retaliation.

Sure, technically the standard is still probable cause. But in reality, holy shit. The evidence they presented to that judge had to be overwhelming. And the DoJ has many extra procedures you have to jump through, and get approval at the highest levels of the Department, before seeking a warrant on an attorney's office. But the President's attorney's office?


My first reaction as a judge would be, "You want me to sign what??"


Edit: This was a no knock, bust the doors down type of warrant and raid. (See my edit below on this.) So in addition to the probable cause for the search, they had to convince the judge that if they knocked on the door and presented the warrant through the normal course of business, documents would have been destroyed. This is extreme.

They raided the president's attorney's office and home. A BFD to use the words of our great former VP.


Edit: 5:31PM Eastern: Wolf Blitzer just confirmed on live TV it was in fact a "no knock" warrant.


Update: MSNBC reporting they've raided Cohen's actual home as well. He was staying in a hotel because a water pipe burst in his home, and was being repaired. So they've raided his office, hotel room, and home.

This is a factually incorrect statement. The President may not use his powers with "corrupt intent". SCOTUS has been very clear about this. Nixon learned this the hard way as well.

Think of it this way- it's totally legal to throw old notebooks in the garbage.

And it's totally illegal to knowingly throw out old notebooks that contained critical evidence for an ongoing investigation in order to try to spare yourself jail time.

Fun factoid: while the Constitution gives the President the power to hire- it doesn't expressly grant the ability to fire. That's defined through case law and post-constitutional law.
