MAGA judge does exactly what one expects a Conservative appointee to do: he over steps his authority to try and retroactively revoke approval of a popular anti-pregnancy medication on religious grounds!
Judge halts FDA approval of abortion pill mifepristone
AUSTIN, Texas (AP) — A federal judge in Texas on Friday ordered a hold on U.S. approval of the abortion medication mifepristone, throwing into question access to the nation’s most common method of abortion in a ruling that waved aside decades of scientific approval.
The immediate impact of the ruling by U.S. District Judge Matthew J. Kacsmaryk, which does not go into immediate effect, was unclear.
The abortion drug has been widely used in the U.S. since 2000 and there is essentially no precedent for a lone judge overruling the medical decisions of the Food and Drug Administration. Mifepristone is one of two drugs used for medication abortion in the United States, along with misoprostol, which is also used to treat other medical conditions.
Kacsmaryk, a Trump administration appointee in Amarillo, Texas, signed an injunction directing the FDA to stay mifepristone’s approval while a lawsuit challenging the safety and approval of the drug continues. His 67-page order gave the government seven days to appeal.

He isn't overstepping his authority. He literally has a case under his jurisdiction that is challenging the safety of the drug. You can disagree with his decision, but he is well within the purview of his authority.

The vast majority of judges are not medical doctors. None of them should ever make rulings on medical cases? Most of them aren’t pilot either, so should they completely stay out of anything aviation related? It is a case within his court. He is within his jurisdiction and right to make his ruling.

Your lack of understanding is epic. Did you bother reading the judge's opinion or are you just assuming it's acceptable because you're pro-life and thus just agree that anything that removes an embryo is just?
The statute of limits has ran, the judge opines that the six year statute of limitations is inconsequential.
The FDA deemed the drug regime in safe. The judge here opines that pro-life advocates here have standing to request the judge overturn that decision because some doctors they represent may be harmed because their theoretical patients might not take their medication properly. So we've got a two-layer hypothetical masquerading as direct harm jurisdiction.
Lastly our pro-life judge has determined that because /some/ states have passed anti abortion legislation, that it has standing to overturn the rights of other state's without such legislation. This is a clear violation of true Supremecy Clause of the Constitution which favors their federal decision to make mifepristone available cannot be superceded by individual states trying to restrict usage for all.

There isn’t a statute of limitations when a new case hits his court. That is like saying the statute of limitations on Jim Criw was up in the 60s because they’d been around for a hundred years. He didn’t ban them, he put a stay in them until further info us gathered. A higher court can review, when it is appealed to, and keep it it drop it. Again, this is how the court system works for everything.

Wow, your ignorance is pretty amazing. You really think judges have an unlimited power to call up any right, product, process or case regardless of circumstances and rule them illegal or unauthorized? No they do not have autocratic power to rule without checks and balances. Judges may only rule without the scope of the law, or interpretation of existing law. They may not legislate or make executive decisions. Yet this conservative judge, dudge? cudge? Said irrespective of the law, science, passage of time, or lack of injured complainant that he would instate a nationwide ban on a rigorously tested, time proven and federally authorized medication.

What part of lacking jurisdiction is hard to parse with that sentence? 22 year old drug, 7 years since a ruling was made on the plaintiff's objection to the drug. Those two items alone should have been an instant dismissal. Tack on the lack of an injured party, no federal rule or law which supports an unlimited barring of medication by judicial officer, lastly the lack of proper venue as the FDA is based out of Washington DC. All grounds for entry of judgment against the plaintiff.
Instead, Judge Fundamentalist applied his logic that because someone might be said to lose a baby they wanted to abort, he's got unlimited jurisdiction to institute a nationwide injunction. Lawl.

The U.S. Food and Drug Administration (FDA) is the federal agency responsible for labeling medications and supplements. However, the approval process is different for prescription and for over-the-counter medications.

Why yes, the executive branch is balanced by the legislation it's presented, that passes or as defined by the Constitution. Likewise the Legislative branch has chosen not to legislate abortion drugs or to repeal the FDAs sole authority. The Biden administration argued that the November legal challenge to the FDA's 2000 approval of mifepristone is "manifestly untimely" and said the group of anti-abortion rights physicians and medical associations that targeted access to the drug lack the legal standing to challenge the FDA's approval of mifepristone, which they neither take nor prescribe.
"The court's sweeping nationwide relief was especially unwarranted given the balance of harms: If allowed to take effect, the court's order would thwart FDA's scientific judgment and severely harm women, particularly those for whom mifepristone is a medical or practical necessity," the Justice Department said. "This harm would be felt throughout the country, given that mifepristone has lawful uses in every state. The order would undermine healthcare systems and the reliance interests of businesses and medical providers."

I think the Judge has more authority over the Executive Branch in this instance because of the Constitution. The only branch of government that can invalidate a Court decision is the Judiciary itself.
What I will say here is that it feels like you're doing exactly what these Trump supporters have been doing for years: you're focusing on this one situation without asking yourself what happens if we normalize this. Even talking about it is normalizing it. The Judiciary only has power because we believe it does. It has no enforcement mechanism for its decisions.
When people start questioning the Judiciary's Constitutional powers, our system breaks down. You're advocating for a Constitutional crisis here and opening the door for the Executive Branch to follow only decisions it agrees with.
The Judiciary has an appeals system for a reason. There is no need to destroy the foundations of our Separation of Powers over this case.

A good start would be to read the 38 page decision, arguments and citations the judge used in his rulings.

You certainly don't seem to mind the Executive Branch sending a group of armed right wing militia to the Capitol building at the exact date and time Congress was certifying an election.
Glass houses and all of that.
1) After an entire special council investigation with millions of taxpayer’s dollars wasted you still lack any evidence to support your statement. Trump said we’re going to march down there and take our country back. That is not a planned insurrection despite your mental gymnastics to try to make it so.
2) The mob was unarmed.
Just like how Seran got triggered and insisted Trump broke the law when he posted a photo holding a baseball bat talking about Bragg, you got played. I’ll give you that Trump goes right up to the legal line to troll people, but he doesn’t cross it.
Edit to add: I don’t like or agree with Trump’s bad behavior post election results, but that doesn’t make it illegal.

Why was it okay for the courts to literally draft legislation out of thin air when it came to abortion, but the courts lack jurisdiction here? Is it because you agree with killing babies so you're okay with the courts getting involved there?

I think what your much smarter liberal-minded friend is trying to tell you is that it’s fine to disagree with the ruling. It’s a completely different matter entirely to say that the courts have no authority and suggest it should be simply ignored. There is a process within the judicial system to work these matters out.

This is all striking me as very familiar to that other judge, in Florida who inserted her personal opinion in lieu of the law and then was unanimously overruled by the court of appeals. Her being admonished by the upper Court was particularly choice. Remember when she tried to assert her authority over an executive branch function and was told that she was a dumb bitch by the court of appeals?

One of your friends suggested that it should just be ignored, but that was not my argument. My argument was that he lacked subject matter jurisdiction all together and should have dismissed the petition accordingly. Which is exactly what the court of appeals will probably do.

You think that a district Court Judge having more authority than the Executive Branch performing duties at outlined by the Legislative Branch because of a belief their ideology supercedes law isn't a failure of our democracy? I'd be surprised if you did.

There's no constitutional argument in restricting mifepristone for one.
State Interest in Protecting Potential Life: One constitutional argument that may be used to restrict mifepristone is based on the state's interest in protecting potential life. Some individuals and groups may argue that life begins at conception, and therefore, fetuses have a constitutional right to life under the Due Process Clause of the Fourteenth Amendment or under state laws protecting the rights of the unborn. From this perspective, mifepristone, as a medication used to terminate pregnancies, could be seen as infringing on the rights of the fetus, and restricting its use could be justified to protect the potential life of the unborn.
State Interest in Promoting Maternal Health: Another constitutional argument that could be used to restrict mifepristone is based on the state's interest in promoting maternal health. Advocates for restrictions on mifepristone may argue that the use of this medication for medical abortion carries risks and complications, and that the state has a legitimate interest in regulating its use to protect the health and well-being of pregnant individuals. This argument could be based on the state's authority to regulate the practice of medicine and protect the health and safety of its citizens, as recognized under the police powers doctrine or other constitutional principles.
State Interest in Regulating Prescription Medications: A third constitutional argument that may be used to restrict mifepristone is based on the state's interest in regulating prescription medications. Some may argue that mifepristone is a prescription medication that should be subject to government regulation, including restrictions on its use, in order to ensure its safe and appropriate use. This argument could be based on the state's authority to regulate the pharmaceutical industry, protect public health, and prevent the misuse or abuse of prescription medications, as recognized under federal or state laws.

Stating the obvious here, but all of that was weighed in the approval of mifepristone and then again when the Church group who initiated the current lawsuit appealed the approval initially. It safely ends a pregnancy that a woman does not want. It has side effects, like any other medication, and can only be prescribed by the order of a doctor. So what then does the overriding state interest entail to determine it's Christian morality supercedes the informed decision of the FDA to decide women are required to bring a pregnancy to term?
No state challenged the approval of mifepristone. You're inferring an argument that was not made. Moreover the lawsuit by the Church group alleges that a hypothetical woman might suffer depression or side effects in taking the medication as it's sole arguments for the injunction, there is no actual affected individual behind the suit. Since we know the FDA approved the medication, that doctors are required by law to discuss the side effects before prescribing, what then is the argument.

Off-topic but I always find it odd when someone makes Biden’s argument that you need F16s and nukes to fight against our government.
1) Tell that to our combat veterans who fought against illiterate insurgents with rusty AKs in Afghanistan, Iraq, Vietnam, etc.
2) Is the US government going to air strike and nuke its own people in their own country?
3) As pointed out and Babylon Bee makes great humor from, according to the left an unarmed mob almost brought down our republic on January 6th. Imagine if the majority of the mob was armed and actually had a plan.
I don’t want a civil war as that would be horrible. We are so fortunate in this country to live in peace. I’ll tell you though, if they ever start rounding people up for transport to some interment camp (like some countries did during Covid)…I’m not getting in that cattle cart. There is a nefarious reason beyond the rhetoric “it’s the only way we can stop kids dying by mass shooting” that those in power want to disarm the public.

That's what gets me.. have guns suddenly become deadlier in the past 3-4 decades? No, they've always been lethal. Has it gotten easier to get a weapon? Nope.. there are more restrictions now than when I was growing up.
So guns haven't changed much.. so it's not the gun that accounts for the uptick in mass shootings.
Has to be something else.. like something in society......
Weird.

As expected, the nationwide ban on mifepristone was overturned for lack of jurisdiction, shocker. Pending oral arguments, the three Republican members of the appeals court issuing the ruling left in place a ban on medications by mail and reversed the extension of eligibility of 10 weeks to 7. This was stayed pending further hearings, but you can bet if mediations by mail is made illegal then the Pharmaceutical lobby will be abandoning Republicans.

So what I hear you saying is that Tesla, having delivered 1.3 million cars GLOBALLY, but also recalled over a million cars in 2022 should be given a pass because even through they recall two-thirds of the vehicles they produce, it's okay. Because somehow, because manufacturers who sell way more vehicles and have a far lower number of vehicles should be held to a higher standard.

The Supreme Court fully stayed the terms of MAGA.Judge's rulings in Texas on mifepristone and remanded the matter to the Fifth Circuit for a full hearing.
Supreme Court says abortion pill mifepristone will remain broadly available during legal battle
The Supreme Court on Friday ordered the abortion pill mifepristone to remain broadly available as litigation plays out in a lower court.
The high court’s decision came in response to an emergency request by the Justice Department to block lower court rulings that would severely limit access to the medication even in some states where abortion remains legal.
The case will now be heard in the U.S. 5th Circuit Court of Appeals. The appeals court has scheduled oral arguments for Wednesday, May 17 at 1 pm CT.
Mifepristone has become the central flashpoint in the legal battle over abortion since the Supreme Court last summer overturned Roe v. Wade, the landmark 1973 decision that guaranteed abortion as a constitutional right nationwide.
Mifepristone, used in combination with another drug called misoprostol, is the most common method to terminate a pregnancy in the U.S., accounting for about half of all abortions.
President Joe Biden said the Supreme Court’s decision keeps mifepristone available to women and FDA approved to terminate early pregnancies. Biden said his administration will continue to protect access to mifepristone in the ongoing legal battle in the 5th Circuit Court of Appeals.
“I continue to stand by FDA’s evidence-based approval of mifepristone, and my Administration will continue to defend FDA’s independent, expert authority to review, approve, and regulate a wide range of prescription drugs,” Biden said.

Trump says he is being treated worse than Abraham Lincoln was.
For the second weekend in a row, Fox host Mark Levin continued showing videos of his conversation with Donald Trump. Among the things Trump thought the Fox audience needed to know is that he was treated worse than Abraham Lincoln, who was killed before leaving office.
Trump began by saying that former President Andrew Jackson was treated very badly after he broke previous treaties, stole land, and forced the march of Native Americans to "Indian Territory." That land was then taken from the Native tribes and became known as Oklahoma.
"Abraham Lincoln, they say, was, you know, he had a civil war going on," Trump educated Levin. "But Abraham Lincoln was just vilified. But now they say Trump got treated the worst of all."
He never explained who "they" were.

So much criminality in the Republican party!
Exclusive: Rep. George Santos charged by Justice Department in federal probe
Federal prosecutors have filed criminal charges against New York Rep. George Santos, the Republican lawmaker whose astonishing pattern of lies and fabrications stunned even hardened politicos, according to three sources familiar with the matter.
Santos is expected to appear as soon as Wednesday at federal court in New York’s eastern district, where the charges have been filed under seal.
The exact nature of the charges couldn’t immediately be learned but the FBI and the Justice Department public integrity prosecutors in New York and Washington have been examining allegations of false statements in Santos’ campaign finance filings and other claims.
During his brief time in office, Santos has been accused of breaking campaign finance laws, violating federal conflict of interest laws, stealing cash meant for an Iraq War veteran’s dying dog, masterminding a credit card fraud scheme and lying about where he went to school and worked.

CENTRAL ISLIP, N.Y. (AP) — U.S. Rep. George Santos, the New York Republican infamous for fabricating key parts of his life story, has been indicted on charges that he embezzled money from his campaign, lied to Congress about his income and cheated his way into undeserved unemployment benefits, prosecutors said Wednesday.
The indictment says Santos induced supporters to donate to a company under the false pretense that the money would be used to support his campaign. Instead, it says, he used it for personal expenses, including to buy designer clothes and to pay his credit cards and car payments.
Santos also is accused of lying about his finances on congressional disclosure forms and applying for and receiving unemployment benefits while he was employed as regional director of an investment firm that the government shut down in 2021 over allegations that it was a Ponzi scheme.
Santos surrendered Wednesday and was taken to a federal courthouse on Long Island, where he was expected to make an initial court appearance later in the day on charges of wire fraud, money laundering, theft of public funds and making false statements to Congress.

Russia is floating a plan to build a village for conservative Americans who want to move to a 'Christian country' and are tired of liberal ideology in the US
Around 200 families have expressed interest in the project, Beslangurov said in a speech at a legal forum in St. Petersburg, the state outlet reported.
Many of these families don't have Russian roots but are tired of "the inculcation of radical values" in the US and Canada, Beslangurov said.
"Today, they have 70 genders, it is not known what will happen next," he added, per RIA Novosti. The same rhetoric has been used frequently by Russian Vladimir Putin as US-Russia relations worsened over the last several years. In December 2021, he compared gender nonconformity to the COVID-19 pandemic.

1. Make it so nobody with business before congress or the senate or a court justice (all courts) can donate to them for one full year from the date their business is scheduled, and one year after their business is resolved.
2. Outlaw lobbying. Period.
3. Limit terms for ALL politicians.
4. Crucify Hillary.
1) Like the idea, but I'm sure it would be found unconstitutional. People have the right to give their money to whomever they want.
2) Same as above.
3) 100% x 1000000000 but it'll never happen because 99% of politicians are about control, power and money and they won't kill the golden goose.
4) For what? Just because you don't like her?

https://www.yahoo.com/news/russia-floating-plan-build-village-071609704.html
Which one of you are one of the 200 families?!
That'd be great, those snowflakes can go live in Russia. Good riddance.

Report from the IEA: https://www.iea.org/reports/solar-pv-global-supply-chains/executive-summary
And if you don't know what the IEA is: https://www.energy.gov/ia/international-energy-agency-iea
"Costs in China are 10% lower than in India, 20% lower than in the United States, and 35% lower than in Europe. Large variations in energy, labour, investment and overhead costs explain these differences. Still, in the absence of financial incentives and manufacturing support, the bankability of manufacturing projects outside of panel assembly remains limited outside of China and few countries in Southeast Asia."
So to save 20% on production costs..... Biden supports:
"Domestic manufacturing can reduce manufacturing CO2 emissions if the local electricity mix is less carbon-intensive than in the exporting country." ----- Increasing CO2 emissions
"The production of many key minerals used in PV is highly concentrated, with China playing a dominant role... This rapid growth, combined with long lead times for mining projects, increases the risk of supply and demand mismatches, which can lead to cost increases and supply shortages." ----- Falling behind in control of key mineral production to China
"The world will almost completely rely on China for the supply of key building blocks for solar panel production through 2025. Based on manufacturing capacity under construction, China’s share of global polysilicon, ingot and wafer production will soon reach almost 95%." ---- Close to 100% reliance on China
"Governments therefore need to turn their attention to ensuring the security of solar PV supplies as an integral part of clean energy transitions. Countries should consider assessing their domestic solar PV supply chain vulnerabilities and risks – and developing strategies and actions to address them." ---- Harming our own National Security
Now... you can read the rest of the International Energy Agency's report for yourself... but what Biden did is nothing good for the United States, and only benefits China.

As far as I understand, I'd have to follow up the research... but both the R and D National Committees are required to hold debates if poll support for a candidate surpasses a certain threshold.
So a candidate meeting that threshold can demand the debate, or acquiesce, to the incumbent.
For example: https://www.politico.com/story/2019/09/23/dnc-debate-1508516
"Candidates will need to clear 3 percent in four DNC-approved polls, up from the 2 percent required to qualify for the September and October debates."
This time the DNC is just deciding, nope! not going to do it at all... even though there are 2 other Democrat Presidential candidates polling over 5%.
So fuck the voters. Fuck their own regulations. Fuck the process. You will only vote for who they want you to vote for.

Found this on the R side also... which I disagree with. I can't find any %'s for competition from the 2020 primary though (perhaps someone else can dig them up)... so no idea if contenders were polling high enough.
It's shitty either way... but more so when such a large % are for other candidates, and their National Committees ignore them. Shameful on both sides IMO.

In 2020, there was no sitting Democrat President.. so they established polling percentages as a way to narrow down the field so we didn't have 50 people running for President on the stage.

High school reschedules graduation ceremony due to only 5 seniors found eligible to graduate
MARLIN, Texas (KWTX/Gray News) - A high school in Texas has rescheduled its graduation ceremony after most of the senior class was found ineligible to graduate.
According to the Marlin Independent School District, the ceremony has been pushed to June to give nearly 30 seniors more time to meet graduation requirements.
According to an audit from the district, 28 of 33 seniors at Marlin High School did not meet the graduation requirements due to their attendance or grades.
“We hold firm to our belief that every student in Marlin ISD can and will achieve their potential,” said Superintendent Darryl Henson. “Students will be held to the same high standard as any other student in Texas.”
Alondra Alvarado is among the five that met the graduation requirements.
“They told us that because of the students that didn’t meet the requirements it wouldn’t be fair for only five students to walk the stage,” Alvarado said.
Salvador Guerrero is one of the 28 seniors who was told he was not eligible to graduate. He said he learned last week that he needs to complete the STAAR test for an online U.S. history course, but the test is not available until the summer.
“It’s a bag of emotions, anxiety, and a bit of disappointment,” he said.
The decision to reschedule the school’s graduation ceremony was made this week. School officials said they are also planning a mandatory meeting with seniors and their parents Wednesday night.

How much of the schools going to remote learning do you think contributed to that? You know, two weeks to flatten the curve.

Considering students have been back in school for over a year and a lot of Texas counties never went remote at all? None. Great attempt at an excuse for shitty administration of schools in Texas.

You know what fixes shitty schools and corrupt teacher unions?
School choice.

Oh, so you think missing in person education for extended periods of time has no lasting impact. Great attempt to sweep under the rug the policies your President forced on the American people, decimating a generation of children and their future opportunities.

Shitty schools are all over the country.. it's not a Texas issue, it's a country issue.
We just keep throwing good money at the problem... when the problem is a corrupt system by corrupt teacher unions and a Department of "Education" that doesn't give a shit about the actual education of students.
School choice.

So weird how you don't have jack shit to say about Baltimore. Well not really, because your piece-of-shittery is extremely predictable.
But let's try again anyway.
Your thoughts on this?

I can agree with that. Had a superintendent in my school district that was arrested by the FBI for embezzling money. Folks can't seem to get enough money that isn't theirs to begin with.

That's a fine deflection, completely incorrect, but creative. Know why fixes student grades? Students being taught lessons and given ample study time in lieu of being forced to work as indentured servants for their parents. Students failing and pour performance is the symptom of shitty hiring practices and oversized classrooms due to lack of proper management by their school district and lack of supervision of their Texas board of education.

I do not "know why fixes students grades."
But can you show me where Texas is forcing students to work? Should be in the law text somewhere.. since you've stated it twice now.
Just show us all where the State of Texas forces 12-14 year olds to work.
Also, "Students failing and pour performance" was just the cherry on your retard sundae post.
Thank you for always entertaining me.. my little Retard Champion.

pour performance
Pour performance, is that pouring the whiskey and beers in the gulags they work in? What is a good pour? I'll ask my bartender next time I'm there, and if there is a scale A-F.
I'm sure recent school performance has nothing to do with being shuttered during covid like to contend.

The whole "by there parents" really escaped your reading comprehension there, didn't it buddy? Texas does enable it though, given the age of compilatory attendance for primary education in that state is one of the lowest in the nation at 14.

Setting aside the part where everything in your post is literally made up, what's your excuse then? You've never worked but look how fucking stupid you are.

It's the pouring of all the beer and whiskey his mom drank while she was knocked up with him.

I've been working since I was 12-13 .. but it wasn't because my parents forced me to work, it was because I wanted money to buy things.
Not everyone is a lazy piece of shit like you. Some people would rather go out and earn their money.. rather than be a ward of the state on their mother's couch.

If it's a Texas school and it has only 33 or whatever seniors it's in the bum fuck of no where, everywhere in DFW all graduating class sizes are well over 600. Truancy and attendance were a thing when I graduated in high school in 03 I ended up paying like 500$ in fines and my dad paid 500$ in fines(i paid 1000$) in fines for skipping school. It had nothing to do with grades they just needed your ass in the chair for the money.
That being said when they had you grade your peers math or read the person next to you essay in a pass back or right fashion. There were a lot of idiots then too.

California leads the pack with the worst graduation rate in the nation.
Also
I fucking hated the labor laws when I was 14, I wanted my own damn money at that age and you couldn't work. Detasseling corn and spraying beans was the only option at 14. It was the first time I ever made $500 of my own cash and I was elated.

Lol, with that .5% below Texas, quite the achievement. The difference between want to work and forced to work? That is the problem, where kids are forced to support a household and loser parents.

You are blessed to have parents that still care for you and didn't force you to work. They probably knew you weren't ready for the real world and have sheltered you from it.
Of course, your parents are probably the biggest reason why you are now a ward of the state, still living on their couch and being this fucking retarded.
So you take the good with the bad.
