Actually that is no longer true. When feet wet/feet dry was in place they were afforded automatic asylum status if they made it to a point above the high water mark or a structure that was attached to land above the high water mark, ie. a bridge. This is no longer the case, Obama ended that policy, and now Cubans are treated the same as any other migrant that makes it ashore.
