Judge dismisses weapons charge in Kyle Rittenhouse homicide trial

A Wisconsin judge on Monday dismissed a weapons charge against Kyle Rittenhouse, the teen who fatally shot two people and wounded a third during a protest in Kenosha last year.

Moments before closing arguments were set to start, Judge Bruce Schroeder dismissed one count of illegal possession of a dangerous weapon by a person under 18.

The misdemeanor, punishable by up to nine months in jail, was considered one of the stronger counts against Rittenhouse. No one disputes he was 17 last year when he walked the streets of Kenosha armed with an AR-15-style weapon.

But the judge cited an exception within the law, dealing with age of the defendant, length of the barrel and hunting, for dismissing that count.

He actually still might get hit with the recklessly endangering safety charges. Apparently self defense doesn't cover those. Both are felony charges, and if run consecutively he could be put away for almost 40 years.

And Rittenhouse wasn't even old enough to openly carry in the state. His gun was also part of a straw purchase. OOOPS! Zingerz omg.

I live in Wisconsin and know the gun laws inside and out. It's going to come down to that. Should a kid that is illegally holding a straw purchased gun allowed to shoot in self defense?

The possession of the firearm being legal or not is not really in the calculus for deadly force self defense. It is really fact specific and needs to be justified in a response to deadly force or serious bodily harm. Once that element is satisfied, it doesn't matter how you apply the deadly force - gun, knife, tire iron, karate, or 10x claid.
