    Honestly it is long overdue for this to have its own thread.

    First up is this complete nonsense:

    Yes that's right. Several high ranking Democrats are planning to visit El Salvador in an attempt to bring a dangerous gang member/terrorist into the US after he was sent back to El Salvador because he was in the US illegally.

    Two courts in the US have already determined that this guy was a member of MS-13, a very violent gang that rapes and murders little kids.

    If Democrats cared even just 1% for innocent American citizens than they do for this violent terrorist then the US would be 100 times better today. Sadly they put violent criminals above innocent Americans every single day, and they are allowed to do this because useful idiots such as Back and Clyder vote them into office again and again and again.

    That's certainly what the Attorney General and other members of the Trump Administration have said in public. But is it true?

    Here are the relevant facts, in my new preferred and awesome bullet point format..

    • Abrego Garcia left El Salvador and illegally entered the United States in 2011 at age 16, fleeing from a criminal gang that threatened violence against him in an attempt to extort his family.
    • He was arrested by police in Maryland in 2019 and handed over to ICE for deportation.

    • Basis of the claim that Garcie is a member of MS-13:
      • In the deportation proceedings, Garcia requested bond while his deportation claim was being processed.
      • The federal government objected, claiming he was a member of the MS-13 gang because he was wearing a Chicago Bulls cap and because of information from an unnamed confidential informant.
      • The confidential informant did not appear at the hearing.
      • The police officer who took the statement from the confidential informant had been suspended for mishandling unrelated confidential information, and the police officer also did not appear to be questioned.
      • The information from the confidential informant was, thus, double hearsay, which is admissible during a criminal bond hearing. During a criminal bond hearing, the government's statements are presumed true, and the defendant has the burden of disproving the government's statements.
      • The judge denied his bond based on the statement of the confidential informant.
      • During his oral statements, the overworked immigration judge said multiple times that Garcia was from Guatemala and other times from El Salvador.

    • Garcia appealed the denial of his bond. The appeals court upheld the denial of bond.
    • As the deportation proceeding proceeded, Garcia asked for asylum in the U.S. because of the threats against his life in El Salvador. That request was denied because asylum requests must be made within one year of entering the country.
    • Because asylum was unavailable, the judge granted him "withholding of removal" status, which provided that he could not be removed to El Salvador.
    • The immigration judge also granted him the right to work legally in the U.S. and released him in 2019. You may wonder why, if the government still believed he was a dangerous gang member, they did not put on actual evidence at the immigration trial.
    • He has reported annually to immigration authorities, as required.
    • Since being released, he developed a skill and was employed full time as a sheet metal worker.
    • He is married to a U.S. citizen, with whom he has children, including a special needs child. He was driving his son home from school when federal agents arrested him.
    • Garcia has never been charged with a crime, neither in the U.S. nor in El Salvador.

    Contrary to Attorney General Pam Bondi's statements, the above is not a basis to send someone to a terrorist prison for life. Bondi is smarter than this, which is why she should be ashamed.

    Is Garcia a gang member? I don't know, and neither does Bondi. She doesn't know because that issue has never been tested in court. If Garcia had been given a habeas corpus hearing, as the Supreme Court said he should have been, then he could have pointed out that a court had ordered that he not be sent to El Salvador and he could have presented evidence that he was not a gang member.

    He does not have the lifestyle that I would have assumed a gang member would have. When does he have time for gang meetings?

    If El Salvador refuses to return him, then there is little the courts can do about it. If Trump sends a U.S. citizen, who has not been charged with any crime, to El Salvador to be held in terrorist prison for life, there's not much U.S. courts could do about that either. It's up to the President and Congress, who might act in response to public pressure.

    I think the reason Trump is fighting so hard to prevent Garcia's return to the U.S. is because Garcia would be the center of attention. There would be an actual highly publicized trial to determine if he is a member of MS-13, with actual witnesses and cross-examination. It might show that he was not a member of the gang, which would mean that Trump's error in deporting him was a much larger error than Trump has so far admitted.

    Thus, Trump cannot let Garcia have an opportunity to rebut the charge that he is a gang member. The way to deny him that opportunity is to pay a foreign self-described dictator to hold Garcia in prison. No one should be surprised if some mishap in prison takes Garcia's life, precluding him from ever telling his story.

    There is absolutely no question that he is a MSNBC-13 gang member. (Pun intended) The mental gymnastics you are taking to defend this guy is hilarious.

    Also, what exactly do you want/expect to happen? The President of El Salvador said he is not sending him back. You want Trump to send our Seal Team 6 to infiltrate their maximum security prison so they can kidnap this guy & take him back into our country? He is a citizen of El Salvador and is in El Salvador. Think about it…
