If only the events on January 6th were limited to protesting outside the grounds of the Capitol Building. They were not. As we've discovered via special counsel Jack Smith, the Trump Campaign had contact with the organizes of the coup attempt who BROKE INTO THE SEALED CAPITAL BUILDING in an attempt to disrupt the certification of the electoral college vote.

The plan as circulated by Trump appointees to Trump and others, was to disrupt proceedings and thus force the electoral vote to be voided and thus a vote of Congress where Republican members had a member majority.

We have motive, premeditation, communication of parties, and execution of the pre-planned events with one goal: keep Trump in office despite his having lost the election.

So your argument is because the Department of Justice used the more serious seditious conspiracy charge due to multiple collaborating entities involve in the coup attempt, in lieu of the single defendant insurrection, is that it somehow doesn't count.
