That distinction could spare Biden from charges like obstruction of justice, but his compliance with law enforcement (as you put it) does not excuse him from any criminal liability for the actual illegal possession of classified documents stored improperly in his garage. Person 1: Has classified docs, it's proven. Denies it, tells lots of stories, hides them, moves them, lies some more.
Person 2: Has classified docs, it's proven. Admits it, returns them, complies with all related requests.

Oh sure, I understand that distinction quite well. In fact, the office of the Archives regularly goes through this exercise, the classified docs issue is one frequently encountered in our government, and generally quickly resolved. They want the docs back, they request them, and 99.9% of the time, you and I never hear about it because people pony up and give the docs back. The ONLY reason the idiot in the news is in the news about this, is because he's the dolt who is the exception to that rule, while blathering incessantly about it and implicating himself every other day. Here is a list of every EO that was done during the Obama administration. Can you link the specific ones that dealt with VP Biden and SOS Clinton being able to have classified materials in their possession after they were both out of office?

This is why you're a dumb cuck. Having classified materials in your possession after you leave public office unless specifically granted continued access is a crime. What determines whether you will be charged or not is the intent and circumstances surrounding how you came into possession of it. Trump took the documents, had he of returned them then it would have been a reasonable error. He didn't do that though. He lied multiple times about having them, despite having full knowledge of their being in his possession and ACTIVELY obstructed the resulting attempts to reclaim them. Trump even went so far as to conspire with others to continue to illegally keep possession. The real coup is the fact he's recorded bragging about keeping such information, despite knowing they were still classified.

The distinction, most people who make the claim that the FBI and DOJ are being weaponized are doing so in full knowledge that it is not. They're intentionally trying to inflict harm against the federal institution with the hopes that it helps them achieve the ends of escaping justice. What makes it so ironic is the number of Republicans who spout that nonsense from a former leader of the Executive Branch who is actively attempting to weaken and destabilize the government he formerly led for his own benefit.
