    I suppose nothing could stop an employer from asking an employee, just seems like an odd thing to do.

    From the EEOC, they aren't prohibited from asking it, but cannot discriminate based on it... So there is no point in asking, unless you want to expose yourself to people claiming that is why they weren't hired.
