Yeah the headlines are (probably) a bit on the salacious side here. I didn't read the whole decision by any stretch, so take this with a grain of salt, but the issue here is mostly around the stealing of protected data, not the password per se.
You'd be hard pressed to try consensual password swapping under the Economic Espionage Act and the CFAA. And you'd be even more hard pressed to try to apply this case to a password situation that didn't involve those violations.
Plus it's the 9th Circuit. SCOTUS's favorite hobby is overturning 9th Circuit Decisions.
