This law is not about porn. If the legislature wanted to pass a law about porn, they could have done so.

No matter how much you demagogue it, the Tennessee law is unconstitutional because it allows a woman wearing customary female clothing, or a man wearing customary male clothing, to give a public performance that appeals to the prurient interest, but punishes a woman dressed in customary male clothing, or a man dressed in customary female clothing, for giving the same exact performance while wearing the same exact clothes. It is not a close call. All Tennessee legislators take an oath to uphold the federal Constitution. Passing laws that they know violate the federal Constitution, even when they are smart enough to realize that the courts will eventually strike down the law, is a breach of that oath.

In addition, the law is dumb because it says that if you want to give sexually suggestive performances to minors you may do so only while wearing clothing typically worn by members of your sex. Surely, that is the wrong message to send. Why didn't they just outlaw all sexually suggestive performances in the presence of minors, regardless of how the performer is dressed? We all know the sad answer to that question.
