This was a motion to dismiss. The "twinkie defense" was a diminished capacity defense, and a diminished capacity defense can't result in a "not guilty" verdict. So you can't use it in a motion to dismiss.

PS the twinkie defense (i.e. diminished capacity) was abolished in California. It's not a valid legal argument for any situation.
