NEW YORK (AP) — Allen Weisselberg, a retired executive in Donald Trump’s real estate empire, was sentenced on Wednesday to five months in jail for lying under oath during his testimony in the civil fraud lawsuit brought against the former president by New York’s attorney general.
More...Does anybody remember how Trump reacted the first time? After Weisselberg confessed that the Trump organization had misreported employment taxes and he said it was all his doing and Trump had nothing to do with it, Trump gave him a raise and a $500,000 bonus, which is not bad for 100 days in jail. Not many people would give a bonus to somebody who intentionally caused their company to cheat on its taxes. Would you go to jail for somebody else for $5,000 per day for 100 days?It is Weisselberg’s second time behind bars. The former Trump Organization chief financial officer served 100 days last year for dodging taxes on $1.7 million in company perks, including a rent-free Manhattan apartment and luxury cars.

In the New York hush money criminal trial, what is the probability that Trump will make a deal with Bragg and plead guilty to a crime prior to the trial? I say 35%. If Trump can get Bragg to agree to a misdemeanor that will not require jail time, then Trump will be eager to avoid the public testimony of Karen McDougal, Stormy Daniels and David Pecker. For his part, Bragg would be relieved to get the matter over with, as would the judge. The only problem is that, under New York's rules, Trump would be required to say in court in person that he committed a crime, and he would be required to describe in public what he did. Excessive pride could make Trump and Weisselberg roommates.
Unlike many states with their soft-on-crime no-contest pleas, when you plead guilty in New York, you give up your right to claim innocence and your right not to incriminate yourself. If this case were in a state that allowed no-contest guilty pleas, like Texas or Florida, then I would revise the probability to 75%.
