No, they are allowed to presume it based on the charges alone. They will basically be seeing the evidence provided to the prosecution by the police that made the arrest.

Naw dude, what makes you the retard is the fact you're debating a guy whose pointing out that headline inflation dropped month over month by pointing out a number which is just a subset of the overall CPI. You can come back to big kids table when you research and figure out the difference.
