If I wanted to pull research and statistical evidence of the harmful effects of marajuana on children, I would - there's tons of data supporting both sides of the pot is good/bad argument. The point being - its common fucking sense and should not have to be backed up by someone shouting for empirical evidence when common sense should prevail.

I think a better analogy would be cigarettes, it used to be thought of as actually a healthy thing to do, smoke, and now it's pretty damn obviously bad, especially for developing children.
Now you can argue about how much of an effect and at what quantities and how repairable the damage is, but a parent who cares about their child would not smoke pot around that child because they wouldn't take the risk. In the same way that parent wouldn't drop them out a 3rd story window, they could live, but... no risk is worthwhile.

In Texas it would be a slam-dunk endangerment of child 3rd degree felony which is what I would make the arrest for. Depending on what they gave the kid and the outcome of a medical review, a prosecutor could argue to bump the charge to 1st degree felony agg-assault if the kid is 5 or under, or 2nd degree if over 5.
As far as a disturbance of the peace, it would allow a common citizen to make an arrest for the offense (please do not do this), or allow a peace officer to make arrest without a warrant even if the activity was not witnessed by said officer.

I've had doctors tell me specifically that you cannot get high from second hand smoke. They specifically also told me that you cannot get a positive on a drug screen from second hand smoke.
The only way you could even get remotely high would be like, if you were in a car and it was completely chonged the fuck out.

Enough is enough when you go talk to them, they tell you tough shit and to deal with it, and then keep bombing the place out, imho.
I think it's pretty gay that you just went straight to the cops without even just leaving a note if not talking to them first and seeing if they tone it down or if they keep smoking the whole building out. Unless I missed something in this thread.
I'm gonna go ahead and assume that these people have no idea they're even stinking up other peoples' places, regardless of how obvious it probably should be to them, and would probably be cool about trying to contain it if it was brought to their attention.

One explanation why the smell might be so strong in the other condos, I used to live in an apartment where all the exhaust fans tied into one vent. If you didn't have your fan on smells would filter through.
I bring one with me to answer the door when I'm not expecting company. I've never pulled it on anyone, and I don't think anyone ever knew I even had it close but yeah I can see that.
I do the same, although it has been seen a time or two, the funniest was when the new LEO my town hired to enforce the local ordinances came to my door. You should of seen the look on his face when I asked him not to freak out that I had a firearm on me and was putting it down to step outside to talk to him. He hasn't came back to the door yet, although he did stop to talk to my wife outside.:tumble:
It is a gateway drug in the sense that dealers will use it as a cheap and easy way to get the young and unsuspecting prospective clients coming back and then introducing them to harder product. I see it all the time on the street.
Wouldn't that be an argument for legalizing it? Make it like alcohol. Taxed, regulated, age limit etc. Then they wouldn't have to go to the dealers. They'd just pick it up the same way they do alcohol now. Older siblings/friends/dads liquor cabinet....

In my much younger days I did smoke a joint or two around my son. He was young enough to not be able to tell the difference between a cigarette and a joint. Although I did sit by a window with a fan blowing out and made sure the smoke was vented, same as when I smoked cigarettes.
Being a parent, but also someone who supports legalization of marijuana, I would not smoke pot in the same house as my kids when I was in any way responsible for them. I feel it's irresponsible of any parent to do so, just like I feel it's irresponsible for any parent to get drunk while in any way responsible for their children.
Me I see it as a matter of degree, a toke or two, or a beer or two after work is one thing. Smoking a QP or downing a fifth of whiskey is another.

I had one and never fired it either but it was more of an investment piece. (got it in part of a trade fairly cheap and ended up selling for $1200 which may seem cheap but considering what I got it for and this was about 10 years ago it was a nice score)
At our gun club you're allowed to use a semi shotty in the competition and this guy tears it up with the M4.
I prefer my Mossberg and secondly the Rem 870. (plus we make fun of the guys with semi autos behind their back)
