Gov. Arnold Schwarzenegger and state Attorney General Jerry Brown said Wednesday they are asking the U.S. Supreme Court to take a look at a lower court ruling that threw out the state's law banning the sale of violent video games to children.

Schwarzenegger signed SB 1179 into law in 2005. The act prohibited the sale or rental of violent video games to those under the age of 18. It also required violent games to be clearly labeled as such.

But the Video Software Dealers Association and Entertainment Software Association quickly filed a lawsuit challenging the law. A U.S. District Court decided in the associations' favor in 2007, on the grounds that the law violated First Amendment free speech rights. The governor appealed to the Ninth Circuit appeals court, but lost again last February.

This is another example of how liberal activist judges are legislating from the bench instead of interpreting the law like they're supposed to. There's no way to know whether or not the current supreme court will uphold this democratically enacted law, but if Obama gets to appoint very many judges to the court, then the new court definitely won't uphold laws like this one passed by democratically elected representatives.

Good idea. Take away their video games so they have more time to shoot each other in the streets.

I have to wonder what you do for a living that you have time to sift through the news every day, spin it, and spew these vomitous piles all over the forums.

This law is unconstitutional. Know how I know this? Besides the fact that I've done the research on it, it's already been declared unconsitutional on MULTIPLE OCCASIONS.

In fact, so has EVERY attempt to legislate the sale of video games since jackass politicians looking for a campaign season sound bite and stump speech talking point started pulling this shit years ago. EVERY attempt has been shot down, and cost the state six figures in legal fees.

First amendment, bitch. Look it up some time, and stop wasting taxpayer money on this bullshit.

EDIT: When the MPAA and RIAA are legally enforced ratings systems, maybe then they'll have a leg to stand on. Which will happen some time after we burn the Constitution.
