According to this brigadier general/lawyer Thomas Hartmann talking on CNN:
1) the trial trial won't start for at least another 120 days.
2) innocent until proven guilty beyond a reasonable doubt, plus an automatic appeal regardless of whether the case is capital.
3) all evidence made public although classified information is going to be made public in some weird way.
4) if the case is capital, guilty verdict must be returned unanimously by 12 military guys. If not, only a 2/3 majority of 5 required.
5) the legality of waterboarding and other "aggressive" interrogation techniques will be determined by whatever judge at the trial (if information from it is presented at all).
6) appeals can be made all the way up to the Supreme Court.

That is good news. A trial on the 9/11 attacks to be held right before the election will remind everyone what is at stake.

So.. really, a 4/5 majority.Yeah, I don't get why they called it 2/3 of 5 either. I guess 2/3 is the general rule for the military and 5 is a particular number for this kind of case?
