View Full Version : Court ruling requires dropping obscenity charges

In another illustration of what a liberal supreme court has caused, police in Virginia Beach had to drop obscenity charges against the manager of an Abercrombie & Fitch store. Police told the manager he had to remove obscene photos depicting a nude girl and several nude boys, but the store manager refused. After the refusal, police charged the store manager with obscenity, but were forced to drop the charges when they were informed that a liberal supreme court in the past had invented a rule saying that anything goes unless it "appealed to prurient interests, were patently offensive to the prevailing standards of the adult community and had no serious artistic value." Based on how that rule, which needless to say is not mentioned anywhere in the constitution, has been interpreted, prosecutors felt that they had no choice but to allow the obscenity to remain on public display where it would be visible to everyone including young children.

That is one reason why this election is so important. Although I do not know how President Bush's two Supreme Court appointments would feel about this case in particular, I do know that with just a couple of more appoints like those made by President Bush, we will be able to reverse at least some of the extra-constitutional decisions made by previous liberal members of the supreme court. I can only hope and pray that it starts with reversing the ruling that allows the murder of unborn children.

No, he's saying the liberal courts of the 60s were the ones who put the standard in place. Which they did.
However, no one on the conservative Burger and Rehnquist courts thought it in the First Amendment's interest to strike it down in the 40 years since the Warren Court ceased to be.
I wonder how long it will take it terms of conservative-jurisprudence-which-still-doesn't-strike-down-so-called-"liberal"-activism for conservatives to realize that the Warren Court validly interpreted the Constitution, and Rehnquist and Burger didn't outright disagree with them?

Chances are that someone(s) looking at those ads (guys in low riders) popped wood. It couldn't be that he(they) was attracted and aroused by the images ... it's not like they were gay or something ... it was the work of Satan.

Virginia Beach's obscenity law, especially fining people for swearing, is the funniest thing ever. IIRC they banned bikinis there too, so there's some sort of coverage requirement.

I've always been a bit befuddled with the oft encountered belief (in the US) that merely viewing a naked human is somehow horribly traumatizing to a child. Images depicting sexual interaction okay, but simple nudity? I just don't get it.

In Iran they would execute someone for such an offense, just as they frequently execute people for being homosexual. That is not what evangelicals want in this country. You have highlighted one of many reasons why Iran is so dangerous to our continued way of life.

I was at work so I didn't originally see the pictures, now that I have- wow, we saw far more revealing (and erotic) photos in my High School photography classes. Far more nudity is on display at the National Gallery of Art. Absolutely stupid of the town to even bother.

Dear lord, there is nothing obscene about the picture, nor anything else that's put up in that store. Considering that most of the 'people' displayed in those pictures are the epitome of health, doesn't it go to say that healthy bodies can help sell clothing targetted at young, fit people?
I'd personally fight their taking down those pics, half my thrill of going to the mall is seeing cracks like the one in that pic.

Purchase transcends any and all alternative lifestyle choices. My roommate was an actual Fengari lipstick lesbian with three booty-cheeks.
Bar is this awesome brewery in New Haven pretty close to Yale/New Haven. They have one day where everything is Purchase-y. The good part is you get to see waitresses tonguing each other. And the bad part is that is very quickly dissolved.
