A somewhat misleading thread title, but how do you all think the opinion from the Supreme Court of New Jersey on gay marriage will affect the elections with only 13 days to go?

Here in Idaho some candidates have started fretting, we already have an amendment to our state constitution to ban gay marriage on our ballot. The justification they have been using is that it is redundant law (already state code) and that it will cause excessive litigation. We're in Idaho, if they were to oppose it on moral/equality grounds it would be political suicide. Now the current reason they've been giving isn't as powerful, because this decision has illuminated the fact that our state Supreme Court could do the same, however unlikely.

My opinion is that I'm tired of states doing things half assed. The NJ court left the decision of whether or not to legalize gay marriage up to another court because they didn't want the political Backlash (heh). They then approved civil unions/domestic partnerships.

It's like every single person is walking on a tight rope. Laws aren't and never have been popular devices, but they are in place to keep our society orderly and just. I get quite angry to see judges pussyfoot around actually JUDGING (and I feel this idea that 'maybe we judges shouldn't have to judge' started with min max sentencing, which is another issue that sets me off).

If nothing is ever judged, nothing can be appealed, thus limiting significant progress in any direction. Boo for judges not having the sack to actually rule. Boo for a state institution anchored so firmly in religion that it prohibits protection for some citizens while freely affording it to others.
