The Trump Organization and its chief financial officer, Allen Weisselberg, were charged Thursday in what prosecutors said was a sweeping, 15-year scheme to compensate top executives of former President Donald Trump's company “off the books” and help them avoid paying taxes.

The Trump Organization pleaded not guilty to charges that included tax fraud and falsifying business records. Weisselberg, 73, pleaded not guilty to grand larceny and tax fraud charges, among others, after prosecutors accused him of personally avoiding taxes on $1.7 million of his income.

Prosecutors say it was an "orchestrated" scheme to compensate executives "off the books" to avoid taxes.

"Contrary to today's assertion by the company's former CEO, this is not a 'standard practice in the business community' nor was it the act of a rogue or isolated employee," Carey Dunne, an assistant district attorney, said in court. "Instead, it was orchestrated by the most senior executives, who were financially benefiting themselves and the company by getting secret pay raises at the expense of state and federal taxpayers."

The $1.7m was Wesselberg himself. For context, that's the median lifetime earning for an American.

It does seem like you're arguing here that it's okay for companies and their executives to engage in systemic tax evasion for 15 years. Or that we shouldn't investigate companies when we have evidence that they are engaging in said tax evasion.

Or does that only apply to businesses owned by former Republican presidents?

Indicting is one thing. Proving and convicting is another. From the charges brought forth, it seems like they are trying to flip him. This seems like a scare tactic, especially including charges about private school tuition and his wife's personal automobile lease. Just my thoughts on it though

Did you read what was going on? Wesselberg was having the Trump organization pay for tuition for family members and then asked staff to remove notes indicating that the checks were for him.

Trump Org was keeping a secret set of books tracking what Wesselberg was getting paid that was completely different from the public books. They would decrease his official salary in some instances to compensate, meaning he wasn't paying taxes on that unofficial income and neither were they. Bonuses to him and other execs were being paid by checks cut from other Trump owned organizations so they could be claimed as non-employee compensation so Trump Org could avoid payroll taxes and the execs had a lower tax liability. He even created a retirement account that gave him significant tax benefits he wouldn't have had otherwise.

Wesselberg was writing checks from the Trump org to other employees and having them cash them and hand the cash back to him for personal use to avoid tracking it as compensation. He was submitting- and then approving- expenses from his personal life (and that of his family). Trump Org was buying them flat screen TVs and apartment renovations. For 8 years Wesselberg lied on his taxes about where he lived so he could avoid New York City taxes. Another family member did the same thing for several years in another freebie Trump Org apartment that was filed as a rent expense, not taxable compensation.

And again- to emphasize here- Trump Org was keeping track of every dime he was getting in unofficial books. And Wesselberg- the *CFO* of Trump Org- was lying on his taxes every year and was instructing them to do this stuff.

All in all, he was making about $100k in untaxed income every year as a part of his comp. He avoided about $1m in tax liability. And that doesn't even count the money his family members were getting.

This is absolutely a way to get him to flip. But this was egregious, classic tax evasion directed by the President and CFO of a company that went on for 15 years and involved millions of dollars.

If that's not the kind of tax evasion we investigate and prosecute, then I really don't know what is.

It's interesting though. There were several points where they directly indicated that Trump knew what was going on. It was very intentional.

But in at least one instance they referred to the President of Trump Org (Trump obv) in one bullet point and then referred to Unindicted Co-Conspirator #1 in another.

Again... this is an indictment meant to bring alleged charges. Which was my whole point. I don't assume guilty because indictments are done. The conviction of those alleged charges is done later, which I know you understand so I don't see why you choose to rebuttal, unless you really don't understand the judicial system. They can indict him on whatever they think will stick, doesn't mean they will get a conviction, which was the point of my whole post. Hold judgement till the process is complete, which is something that people have failed to understand ever since Trump got elected as President and everyone has lost their damn minds.

They can draw parallels and connections directly/indirectly all day long, but until they get done with the judicial process, everything is allegedly.

When they are trying to get someone to flip on someone, they usually have something on them. This dude would have one of the most expensive lawyers you can buy. He'd be able to see right through some bullshit. They probably very much have something they think could secure a conviction on what he was charged with.

The Misreporting of Employee Compensation as Non-Employee Compensation

15. As a further part of the scheme to defraud, the defendants misreported portions of the employee compensation paid to certain Trump Organization executives, including but not limited to Weisselberg. Specifically, it was the practice of the Trump Organization to compensate certain executives by paying them a yearly salary and a discretionary end-of-year bonus. The salary and, in most instances, a portion of the executives" end-of-year bonuses were paid to the executives by Trump Payroll Corp. and reported to federal, state, and local tax authorities as employee compensation on W-2 forms. However, for Weisselberg and other executives, a substantial portion of their end-of-year bonuses was paid in the form of checks drawn on other Trump Organization entities, including Wollman Rink Operations LLC, Trump International Golf Club LLC, the Mar-a-Lago Club, Trump Productions LLC, VH Property Corp., Trump Las Vegas Development LLC, Tramp CPS LLC, and other entities.

16. The end-of-year bonus checks drawn on entities other than Trump Payroll Corp. were routinely reported to tax authorities as non-employee compensation, and set forth on United States Internal Revenue Service 1099 Forms, which are used to report non-employee compensation. This practice, as the defendants knew, was improper. The end-of-year bonus compensation received by the executives was employee compensation and should have been reported as such. By reporting portions of employees' bonus payments as non-employee compensation, the defendants made it possible for those employees to report the payments as self-employment income.

17. Additionally, by reason of having reported substantial non-employee compensation, Weisselberg was able to make annual contributions to a Keogh plan, which is a tax-deferred pension plan that s available to self-employed individuals for retirement purposes. Weisselberg was not a self-employed individual. But, because he purportedly received substantial non-employee compensation from the entities such as the Mar-a-Lago Club and Wollman Rink Operations LLC, as set forth above, he falsely reported the receipt of self-employment income and thereby falsely claimed that he was entitled to an annual exclusion from his income of amounts contributed to his Keogh plan. The amounts so contributed for the tax years 2012 through 2016 exceeded approximately $215,000, and over the course of the scheme to defraud, Weissclberg was able to build up a Keogh plan worth many hundreds of thousands of dollars. Weisselberg knew that the exclusions from his taxable income of his contributions to his Keogh plan were improper. By falsely reporting that executives including Weisselberg had received non-employee compensation, the defendants enabled Weisselberg to benefit from Keogh contributions that he was not lawfully 'permitted to make, and thereby to defraud federal, state, and local tax authorities.

There's no feasible way that a CFO of large company can get up and argue ignorance of basic tax law in the Courts.

There's also no legitimate reason why you would pay executive bonuses from another entity, nor any legitimate reason why you would pay employees and then mark that as non-emoyee compensation.

That's the thing about this case- there really are no legitimate defenses to what was going on. They got caught with a separate set of books. That's pretty slam dunk as far as intent goes.

The thing that I don't think has quite occured to some of our friends in this thread yet though is... What are the odds that they kept that separate set of books JUST to record real employee compensation?

Tgo I don't think you understand how these kinds of cases work.

No one here knows what else there is, if any, but it's highly unlikely that they would be squeezing Wesselberg so hard while referencing other unindicted co-conspirators, other execs involved, and Trump's own knowledge and participation in some of the incidents outlined in the indictment if they didn't have more to come.

And while it's possible that the blatant tax evasion going on for the execs is the only corrupt part of their business practices, it's not exactly what I would call a safe bet.

And if you could take off the political blinders for a moment, you would see that they were breaking a lot of laws, repeatedly, for 15 years (at least). And they shouldn't be immune from consequences for that just because they work for a former President you happened to have liked.

In both instances the Republican Senators tried to get through it as soon as possible and were going on record telling everyone they wouldn't vote to convict him regardless of what happened in trial. For those of us who aren't Republicans, hearing the constant drumbeat of stolen elections/elections fraud/widespread irregularities on the right is flabbergasting honestly.

We have a recorded call where Trump called up Georgia and told them to change the vote tally. "Find the votes" "Find the Fraud". He was sowing doubt about the election results far before the election happened (and he did it for every election). He organized a rally of militant supporters, told them they were at war, and set them loose on Congress

Congressional Republicans tried to overturn the election results not that long ago. And for years, we've watched them pass laws that heavily restrict the number of acceptable IDs you can use to vote (especially things like college IDs which tend to result in , substantially decreasing early voting periods, and making it harder to vote by mail. We've seen them close the polls on Sundays specifically- which is when Souls to the Polls happens.

Republican state officials have closed thousands of polling locations- targeting urban areas and minority communities by a factor of like 10:1 I believe. They purge voter registration rolls- particularly in democratic leaning areas. Georgia tried to do that *during early voting* last election. You're not notified when you're purged by the way. Your ballot is just rejected.

There was a pandemic that resulted in over 600k dead Americans (and counting), and Republicans were suing states who were trying to let more people vote by mail so they didn't have to risk their lives and didn't end up creating another COVID wave. They were willing to let Americans die in hopes of keeping low propensity voters out of the election.

When we look at that (not just us- international elections observers)- that's where we see the real fraud. It's a systematic attempt to make it harder for people to vote if they're suspected of not voting for the party in power.

But then we hear people complaining about these supposed widespread or significant irregularities that no one can find. Or these millions of undocumented people somehow managing to vote (which is virtually impossible, and no undocumented immigrant would ever risk going to prison or being kicked out of the country to cast a single vote out of hundreds of millions).

How do you square all of this? I'm genuinely curious. If you're worried about keeping free and fair elections- why aren't you worried about what the people you're voting for are doing right now to keep people from voting?

Yeah...The Mueller report pretty much confirmed everything that had been reported on in terms of improper contact between the Trump campaign and Russia's intelligence services. It also pointed out new ones that hadn't been previously reported on. (Remember our MAGA loving friends on this forum started calling CNN, NYT, WashPo, etc "fake news" because of their reporting on these improper contacts...which turned out to be absolutely accurate)

We also know the Mueller investigation was severely limited in scope. They were only allowed to look at Russian election interference and the Trump campaign's possible involvement with that. The report made it very clear that there were numerous, improper contacts between the campaign and the Russian government, but they didn't find enough evidence that the campaign was directly involved in coordinating the actual attacks to indict on criminal conspiracy charges. Basically it was clear that the campaign was happily talking to the Russians, literally providing them with comprehensive polling data, was made up of people with significant financial and political ties to the Russian government and oligarchs, constantly met with cutouts of the Russian intelligence agency, and was happily benefitting from the Russian attacks, but there wasn't enough evidence that they were working with the Russian government during the initial hacks and such. In part because Trump's legal team was offering pardons to people like Manafort if they stopped talking to investigators.

There were also quite a few people convicted of lying to investigators and Congress, by the way. You don't risk those charges unless you know that the truth would land you in a much worse situation.

And finally, Trump's own personal AND financial ties to Russia were also specifically prohibited from being investigated. So he was by no means exonerated.


So this fantasy that conservatives are running around spouting- that somehow Trump and his campaign were found innocent of illicit cooperation with the Russian government while running a political campaign is utter nonsense. He wasn't really investigated, he was trading Pardons for silence, and multiple members of the campaign were confirmed to have had improper contacts with a foreign adversary.

Again, the IRS isn't unconstitutional. There are many independent agencies that were created by Act of Congress (Lincoln signed the bill into law, but only Congress had the power to establish the IRS). The IRS is no more unconstitutional than the FTC, FCC, or EPA.

I'll also point out that there's a reasons why only a handfull of countries have a flat tax- and why none of them are particularly well developed. A flat tax may seem to make sense on paper, but it's a REALLY bad idea. Not only does it starve the country for revenue (which means it can't do a lot of the things we need a country to do), but it also leads to rampant income disparities, which in turn leads to rampant inflation. A progressive tax is the only sensible approach for a large country, in particular.

You may want to read my comment again. I said **taxes** are essential, and that no one builds a country without them. I didn't say *income* taxes specifically were universal. They are now, but, as you point out, they weren't always. (Income taxes are hard to determine or collect without certain infrastructure that just didn't exist in the early days of the country) But excise taxes were there from day 1, as you sort of pointed out.

They are now, but, as you point out, they weren't always. Yeah...The Mueller report pretty much confirmed everything that had been reported on in terms of improper contact between the Trump campaign and Russia's intelligence services. It also pointed out new ones that hadn't been previously reported on. (Remember our MAGA loving friends on this forum started calling CNN, NYT, WashPo, etc "fake news" because of their reporting on these improper contacts...which turned out to be absolutely accurate)

We also know the Mueller investigation was severely limited in scope. They were only allowed to look at Russian election interference and the Trump campaign's possible involvement with that. The report made it very clear that there were numerous, improper contacts between the campaign and the Russian government, but they didn't find enough evidence that the campaign was directly involved in coordinating the actual attacks to indict on criminal conspiracy charges. Basically it was clear that the campaign was happily talking to the Russians, literally providing them with comprehensive polling data, was made up of people with significant financial and political ties to the Russian government and oligarchs, constantly met with cutouts of the Russian intelligence agency, and was happily benefitting from the Russian attacks, but there wasn't enough evidence that they were working with the Russian government during the initial hacks and such. In part because Trump's legal team was offering pardons to people like Manafort if they stopped talking to investigators.

There were also quite a few people convicted of lying to investigators and Congress, by the way. You don't risk those charges unless you know that the truth would land you in a much worse situation.

And finally, Trump's own personal AND financial ties to Russia were also specifically prohibited from being investigated. So he was by no means exonerated.

So this fantasy that conservatives are running around spouting- that somehow Trump and his campaign were found innocent of illicit cooperation with the Russian government while running a political campaign is utter nonsense. He wasn't really investigated, he was trading Pardons for silence, and multiple members of the campaign were confirmed to have had improper contacts with a foreign adversary.
