    Senator Roger Wicker predicted President Joe Biden's Supreme Court pick will be an affirmative action beneficiary who will "misinterpret the law" during a radio show interview on Friday.

    After Justice Stephen Breyer announced his retirement last week, Biden doubled down on a previous pledge to nominate a Black woman to the Supreme Court, which would be a historic first. While many have lauded the promise as progress, some Republicans have criticized Biden for considering race and gender in his pick.

    Wicker, a Mississippi Republican, told SuperTalk Mississippi radio host Paul Gallo he believes the Supreme Court seat will go from someone who is a "nice stately liberal" to someone "more in the style of Sonia Sotomayor."

    Even though Biden has not announced who the nominee will be, Wicker predicted she will not receive a single Republican vote.

    Three things to talk about..

    First, why does Wicker assume that Biden's nominee will be a beneficiary of affirmative action? Affirmative action is picking someone who is not the most qualified just because of the person's ethnicity.

    Second, he said Sotomayor is not "stately." Ha ha.

    Third, he predicted that Biden's nominee would not get a single Republican vote.


    Shortly after Wicker delivered his remarks, Lindsey Graham heaped praise on one of Biden's top contenders..

    MARGARET BRENNAN: President Biden has promised to name a black woman to replace Supreme Court Justice Stephen Breyer. Contenders include Ketanji Brown Jackson of Washington, D.C., Leondra Kruger of California, and Michelle Childs of South Carolina. The only potential nominee that the White House has publicly acknowledged being under consideration is Childs.

    South Carolina Republican Senator Lindsey Graham joins us from Clemson, South Carolina, this morning. Good morning to you, Senator.

    SENATOR LINDSEY GRAHAM: Good morning.

    MARGARET BRENNAN: As you know, coming up on this program, Congressman Jim Clyburn, he has said repeatedly in interviews that South Carolina Federal District Judge Michelle Childs, not only as someone he likes, but that both South Carolina Republican senators will support her. So he's talking about you. Did you tell him you're a yes vote on Childs?

    SEN. GRAHAM: Here's what I'll tell him and the nation, I- I can't think of a better person for President Biden to consider for the Supreme Court than Michelle Childs. She has wide support in our state. She's considered to be a fair minded, highly gifted jurist. She's one of the most decent people I've ever met. It would be good for the court to have somebody who's not at Harvard or Yale. She's a graduate of the University of South Carolina, a public education background. She's been a workers comp judge. She's highly qualified. She's a good character. And we'll see how she does if she's nominated. But I cannot say anything bad about Michelle Childs. She is an awesome person.

    Was Wicker right about a single thing he said? Graham is smarter than Wicker. A lot smarter. The writing is on the wall. In fact, it would be better if Wicker said nothing at all and let Graham do the talking. Better for Republicans to support the nominee and get it over with so that they can focus on less favorable parts of Biden's presidency. Biden would be much better off politically if most Senators follow Wicker's dumb example than if they follow Graham's smart example.

    To use the current laws already on the books: "Equal Employment Opportunity (EEO) laws make it illegal for employers to discriminate on the basis of certain characteristics. This means individuals are entitled to be free from discrimination on the basis of race, color, religion, national origin and sex."

    It's not me saying what Joe Biden said is wrong... it's that the laws regarding Equal Employment Opportunity does....

    I don't care what color, race, whatever is selected... I am against him breaking the law and openly stating that he will do it solely based on "race, color" in contradiction to the laws on the books.

    People that can't understand that, really don't understand much.


    Edit: It would be hilarious, and if they're judicially minded... during the confirmation hearings if the candidate is black, made the argument that their appointment breaks EEO and the offending party should be held accountable. They wouldn't be wrong... I know will never happen, but damn that would be someone I could respect the hell out of. A pure legal, logical, and blind application of the law.

    yeah interesting. Is the appointment considered the employment, or is the person being voted for/against the employment as it relates to an EEO concern?

    If he nominates a black female midget, I can get on board with that.

    Know how many midgets are in office? Zero. Biden needs to fix that.

    Do you honestly think Congress and the President would pass laws that apply to themselves? Members of Congress don't even pay their parking tickets.

    Honestly anyone at that height is going to be just as qualified as anyone else. I think it would have been better if he had kept the "I'm only selecting a black woman" to himself and just did it. I feel it kind of cheapens it.
