McCabe has requested the Senate Judiciary Committee promise not to use his testimony to prosecute him after he appears before an upcoming congressional panel that will look into how senior officials at the FBI and Justice Department handled the investigation of Hillary Clinton's private email server, according to a letter obtained by CNN.

"Under the terms of such a grant of use immunity, no testimony or other information provided by Mr. McCabe could be used against him in a criminal case," wrote Michael Bromwich, a lawyer for McCabe, to Senate Judiciary Chairman Chuck Grassley, who has requested McCabe testify next week.

“We hereby request that the Judiciary Committee authorize a grant of use immunity to Mr. McCabe,” to ensure “no testimony or other information provided by Mr. McCabe could be used against him in any criminal case,” Bromwich wrote in his letter.

“If this Committee is unwilling or unable to obtain such an order [of immunity], then Mr. McCabe will have no choice but to invoke his Fifth Amendment privilege against self-incrimination,” Bromwich added.

It's actually pretty standard for witnesses to ask for Immunity as a part of coming in. Any good defense attorney would request it beforehand.
