Maybe moderate Republicans are a bit smarter about seeing that Democrats are the only ones capable of accomplishing anything.
The democrats plan is going so well that even democratic sanctuary cities are saying they don't want any more "immigrants". The president also ended the executive orders from the previous administration that were working pretty well on his first day in office. So this win you are trying to declare is only due to his own failures.
I believe what you meant to say was that Judge Emmet Sullivan of the U.S. District Court in Washington DC found that the usage of Title 42 as an ongoing basis was improper and that implementation was arbitrary and capricious. The Biden administration also determined the Covid-19 emergency ended and found that the existing Title 8 immigration laws in place were the appropriate existing immigration laws present in place.
The Supreme Court denied further challenges on the matter. To quote Justice Gorsuch:
"I do not discount the states' concerns about what is happening at the border, but 'the current border crisis is not a COVID crisis,'" Gorsuch said.
"Many lessons can be learned from this chapter in our history, and hopefully serious efforts will be made to study it," he wrote. "One lesson might be this: Fear and the desire for safety are powerful forces....We do not need to confront a bayonet, we need only a nudge, before we willingly abandon the nicety of requiring laws to be adopted by our legislative representatives and accept rule by decree."
Congress failed to act as invited by Justice Gorsuch, due to the intervening demand by notorious felon Donald Trump to Senate Republicans. President Biden has therefore made a new executive order consistent with Title 8.
So again, rather than blame Democrats who are existing pursuant to federal law, you need to properly express your ire at Congressional Republicans for failing to act despite both the executive and judicial branches extoling them to do so.
