View Full Version : Kobe Bryant: a civil matter

DENVER, Colorado (Reuters) -- The woman who accuses basketball star Kobe Bryant of rape sued the Los Angeles Laker in federal court Tuesday for an unspecified amount of monetary damages.
In the lawsuit filed in federal court in Denver, the woman under the name of "Jane Doe" claimed Bryant raped her when she was bent over a chair in his hotel room in a Vail-area resort last year -- a claim that matches the criminal charge against him.
Bryant, 25, who is scheduled to go on trial in criminal court in Eagle, Colorado, later this month, has pleaded not guilty and said the two had consensual sex on June 30, 2003.
Bryant's criminal attorney Pamela Mackey was not available to comment.
The judge in the criminal case last week expanded a gag order on everyone involved in the case after the accuser's lawyers, John Clune and Lin Wood, said on national television that mistakes by court staff that identified the women meant that she may need to reconsider testifying at the upcoming criminal trial.
In the civil lawsuit, the woman who is now 20, claims that when "she was bent over the chair and forced by defendant Bryant to remain in that position, defendant Bryant sexually assaulted and raped plaintiff, by unlawfully and knowingly inflicting sexual intrusion and penetration of her vagina against her will and without her consent."

Wonder if this is because the burden of proof is less stringent in civil court than in the criminal court...? (good example is how OJ was sued and lost after his victory in criminal court)
Or is she finally getting down to the root of the matter ??? $$$,$$$,$$$.$$
And why file now while the criminal trial is ongoing??? Does she hope to overwhelm with litigation and push him into a settlement out of court?
It certainly makes one wonder. It also makes one glad one isn't in his shoes.
She is filing now <no surprise> because I honestly don't think she has a good chance of winning her criminal court case. With her sexual history having been exposed and the events before and after the encounter with Kobe being brought to light and being a topic of discussion. It's also much easier to win a civil suit as we've all seen, the burdeon of proof is not as heavily waged.

She's going through the formality of filing a civil case so she can settle out of court for x million dollars. It won't even get to trial, and the federal case will most likely be dismissed.

Yeah definitely makes it seem that way. Kinda proves all the people who didn't/don't believe her right.
I kinda have to agree on money being a motive at this point. Why wouldn't she want the case to go to trail if there is no doubt on his guilt. Definitely makes you wonder...

I know not everyone will behave and react the same way, but if some guy really and truly raped me, I'd drag him through federal court and hope for a conviction. Really, what harm is it going to do Kobe if he has to pay out a few mil? The true punishment for guilt would have to be prison time, time away from his career and family.
Yes, it's all about the money. No, I don't think he's guilty of raping her.

P.S. I do also remember her saying in the beginning of this hoopla that she wouldn't file a civil case because it WASN'T about the money. Changing her tune now, it seems.

I'd claim Kobe raped me too if I had enough DNA for a rape kit. Then I'd settle out of court and be the guy that got "raped" by Kobe. I'd also be the guy with 20mil.

Actually, the MAXIM article I read said that according to Kobe's statement, she was a willing participant the entire time and only became "distraught" after he ejaculated in her face.

I'm not sure if this was Kobe or the Micheal Jackson case (In my Current World Affairs class last year we focused on those two for like half the year) but wasn't she offered a few million first and she declined it and wanted to take him to court?
I'm not sure if she's wrong or not but with the way they're trashing her, I'd want to sue them too.
Kobe will pay for his indescretion by writing the check to his lawyers when this is all over... hit em where it hurts, his pocketbook... and I'm sure we've not heard the last from his wife on this matter either.
The psycho wench will still get money with interviews and articles that she'll receive the compensation from... even though she's going to lose both cases... because she's only in it for the money...

I disagree that Kobe will be "hurt" by having to pay out legal fees, or even if he's made to pay out a settlement. The guy is so freaking rich it doesn't matter, anyway. If you wanted to really hurt him, make him go to jail. Of course, since he's not a rapist, I don't think he deserves that.

There is a law on the books that will prevent Kobe from settling. If he settles, he will be viewed as guilty of the charges and will be automatically entered into the "sex offenders" data base meaning he will have to register in every state he plays in.
I'll find the law when I get a minute.

Ok say he really did rape her. There's no way for her to 100% prove it especially after all the shit they dug up.
Now go the other way and say that he didn't rape her and he was convicted of rape. Again, there's no way to truly prove he didn't because no one can see what happened in that room. So technically the truth would never really be known.

The only reason I think Kobe is on the guilty side is because his team wanted nothing to do with it. Who knows Kobe well? Lakers do. Is he divorced yet? His wife is hooooot!

I don't know about that, Backlash. I don't think the Lakers wanted nothing to do with it because they think he's guilty per se. I think they just want to be careful.

2) If this girl was really raped.. would she have the need to have sex the next day?
