11-Year-Old Accused in Maine Baby Death Arraigned

SKOWHEGAN, Maine

The youngest person to be charged with homicide in Maine in at least 30 years — and possibly ever — twiddled her fingers, bit her nails and looked down on Monday during her first court appearance. Afterward, her attorney said the manslaughter charge was "too harsh" for someone so young.

The girl was charged over the summer at age 10 with juvenile manslaughter in the death of 3-month-old Brooklyn Foss-Greenaway, who was staying overnight in the girl's home in Fairfield in the care of the girl's mother.

The girl, now 11, entered a juvenile plea called "no answer," which is neither a denial nor admission of the charges.

The girl's mother called police early on July 8 to report that the infant was not breathing, authorities said. The infant, who was reportedly fussy, was sleeping in a portable crib in the 10-year-old's bedroom that night, said the infant's mother, Nicole "Nicki" Greenaway of Clinton.

The state hasn't released the cause of death, but Greenaway was told that her daughter ingested medication and was suffocated.

Outside the courthouse, defense lawyer John Martin said manslaughter was an "extremely severe" charge for someone who's so young. "When I say too harsh, I mean she's just 11," Martin said. "It's harsh. There's no other word for it."

But Greenaway said the mother should be held accountable, as well, since she left her daughter in the bedroom, leaving her infant without adult supervision.

"I feel that she does need to be charged. To me right now it makes me feel like she's allowing (her daughter) to take full responsibility," Greenaway said.

Greenaway left the court hearing angry and frustrated, saying she felt that the girl and her mother were smirking. The girl's mother left without talking to reporters.

Assistant Attorney General Andrew Benson declined to comment on whether there could be additional charges.

The girl, who had her hair pulled back and wore glasses, sat quietly with her eyes down for most of the brief hearing. When the judge asked if she understood what was required of her, including cooperating on a competency examination, she simply nodded.

The Maine Department of Health and Human Services, which removed the young suspect from the home, faulted the baby sitter for leaving the infant in the room with the girl. In a letter, an agency case worker said the 10-year-old had a behavior disorder that made her unsuitable for caring for the infant.

The Associated Press generally does not identify juveniles accused of crimes.

If convicted as a juvenile, the maximum penalty is incarceration until age 21. For an adult, manslaughter carries a maximum penalty of 30 years in prison, but the state opted not to try the girl in an adult courtroom.

To protect the girl's privacy, Maine District Court Chief Judge Charles LaVerdiere issued a special order warning that no recording device of any type was allowed in the courtroom Monday. Afterward, an umbrella was used to shield her from photographers as she left the courthouse.

During the hearing, LaVerdiere ordered a competency evaluation that'll help establish the path for the case. "Procedurally that's going to kind of guide the way this case goes," Martin said afterward. "That first determination is something that's going to be important in this case."

Um. Why was a fucking 10 year old child caring for an infant? Why is a 10 year old child being charged when this infant was left with the child's mother to care for? I'm all for little punk ass kids getting what they deserve, but this seems pretty odd to me. The adult, the person left in charge of the infant, the mother of the accused, is the person who should be in trouble here unless I'm missing some real key info.

I don't think the infant was "left in charge." They were sharing the same room that night.

I read the part about the cause of death supposedly being suffocation and ingesting medication and I had assumed they thought the 10 year old girl killed the infant but with a charge of manslaughter it does sound as if she's being charged for the accidental death of the infant. Either that or they didn't want to charge a 10 year old with murder so they reduced the charge to manslaughter.

Maybe not; I was mostly going on the verbage here: "the 10-year-old had a behavior disorder that made her unsuitable for caring for the infant". It could be that in these situations leaving an infant in a room with another child is considered placing the infant in the care of the child. It sounds stupid, but there's a lot of dumb shit that goes on in our world and laws are no exception. Why else would that statement have been made by a Health and Human Services case worker?

Without really knowing how and why the child died, it's hard to point fingers considering medication could lead to asphyxiation. We don't know why any medication was in play or if it really was at all. What we do know is that an infant died in the home of a woman who left the infant, overnight, in a room with her ten year old child. If the baby was suffocated, did the ten year old toss a pillow or something over the baby to keep it quiet or did she go over and hold her hand over its face? Even at ten, I would think most normal, well-taught children would know that doing something like putting a pillow over an infant could have very bad results. If, as a parent and someone who is watching an infant, you don't know how your ten year old will behave with this infant, it's on you if something happens when the two are in a room together. Now, a 'behavior disorder' was mentioned in the case of the ten year old. We don't know what that disorder is or if there truly is one, but if there is, that makes it even more clear that the mother (you know, the adult in this situation charged with housing/watching an infant child) is responsible for putting both children in the situation. At all times, it is the responsibility of the adult, who was given charge of the infant, to make sure the child is in a place safe from any potential harm.

Personally, I don't know that I'd be comfortable at all leaving my infant child with someone else. If I were in a position that it had to be done, I think I'd want to know some details regarding the sleeping situation. Infants are noisy and annoying. They wake up at any random time. If I were to leave my child with another family, I would have to know these people well. If there are other children in the house, you've got to be sure that the adult has a handle on the other children and that the children themselves aren't little demons. So, depending on how well the mother of the infant knew the people watching her child, you might have to put some of the blame on her. At the end of the day, though, all the legal problems should belong to the adult that the child was left with.
