View Full Version : Samsung - Apple juror foreman had previously lost house due to Samsung owned company

I've been following the "rounded edges on a rectangle" Apple vs Samsung patent case with great interest. Having patented several things of my own and being of the opinion that our patent system is essentially broken. Apple was awarded over a billion dollars in damage from Samsung. One of the interesting thing was the jury Foreman who had strong views on the patent systems having filed his own patents and by all account essentially led the jury to the verdict.


Today Samsung asked for a retrial because he didn't disclose during voir dire a 1993 case in which Seagate sued him which caused him to lose his house and file for bankruptcy. Samsung is the biggest stake holder in Seagate. Also the lawyer that represented Seagate is married to a partner at the law firm that represented Samsung. Although that's all pretty damning my understanding is that after the trial is actually completed it's usually very unlikely to have a case dismissed or retried based on juror misconduct. Any of our PC armchair lawyers care to comment?
