My gf was eating cookies when she found one that had an insect INSIDE it.
I told her to seal off that cookie and to show it to me.
It's really disgusting when you consider that 99% of the time you take handful of cookies and eat em without looking at em.
Anyone knows if I could sue the bastards (kraft) and win millions because of that cookie?

I don't think you can unless she ate the bug and has suffered some kind of physical or mental ailment from doing so, but I'm not positive.

MY point to her was the following: You can east ants and not be ill, still, by HAVING the cookie and sealing it, you're proving it was them that had the problem AND that it can happen.
So maybe we ate like 400 cookies with bugs in em, maybe none, but hey...

I doubt very much that the Canadian legal system considers what you have as undeniable proof.
I would suggest just not buying from Kraft or calling an exterminator.

The average human eats lots of bugs in a lifetime.
Chocolate alone has a % of bugs in it. But it's kept at a small enough of a % that it is not needed to be listed as a product inside it.

Did a bit of searching...

Almost every food you eat contains insects in some way or another, and it hasn’t harmed anyone yet. "

"It depends on whether the trace ingredient is present in a significant amount and has a function in the finished food. If a substance is an incidental additive and has no function or technical effect in the finished product, then it need not be declared on the label. An incidental additive is usually present because it is an ingredient of another ingredient. Sulfites are considered to be incidental only if present at less than 10 ppm.
21 CFR 101.100(a)(3)"

You can't sue em, simply because you can't prove the bug wasn't put there, or didnt crawl in there at the grocery store.
You could have sued them if there was a razor blade though, funny that.

Why am I not surprised that X wants a payday for finding a bug in a cookie.
How about this, E-mail Kraft and let them know. They will respond with an apology, maybe even send you bunch of free shit for the trouble.
Shit happens and it's fucks like you; the kind that thinks get rich through legal action, that end up making the rest of us consumers pay out the nose.
Throw the cookie away and get on with your life.

The bug is kinda PRINTED in the cookie and not just on it.
You see a mark of the bug a bit bellow and on the corner it is there but almost inside the cookie.
I don't think it's normal to find those kind of things still.

Sheesh, guys the guy had a good question. I know it's X, but let's show at least a smidge of maturity, alrighty? At least, until he starts something first?

Anyways, X, I would write them a letter about it. They do need to know if bugs is in their product. I don't think suing will do much good unless it made you ill, and it resulted in doctors bills. The best that could come out of it is if they gave you your money back, and perhaps some other things too.
Maturity doesn't exist in threads created by X.

Sorry, but odds are, you will lose. I'm sure the company kraft has an army of lawyers who already came up with a defense way before thousands of their cookies were baked.
It would be ironic that if you do pursue this matter in court, you will just lose thousands of dollars in legal fees, unless the judge dismiss your claim.
She didn't eat the cookie, therefore your legal ground to win anything is a settlement for just another bag of cookies, and maybe a side order of kraft dinner. Quick rich scheme much?
Or she could take a bite out of the cookie.

I'll respond two different ways.
1. How to get the most money out of this. Call the 800 number on the package. Explain your complaint in detail, explain that you still have the cookie, and that while you're not planning legal action, you would appreciate some form of compensation. They will request that you send them the cookie. Do it. They will not assist you any further if you don't.
They will then do one of two things. They will either offer you free coupons/credit/something along those lines, or they will forward you to their insurance company. If you want money, decline the coupons, etc. They'll most likely forward you to their insurance company then.
Their insurance company will contact you and take your statement. Again, request that you be compensated for your "trauma." They'll most likely offer you somewhere between 50 and 250 dollars to go away. Take it. You won't get more. If you refuse their offer, you're stuck with going to court. You won't win.
2. How to be a decent human. Call them, tell them about the problem. Don't be a slimebucket, throw the fucking cookie away, take your free coupons, and get over it.

Jorddyn, I think you made an excellent post. What you're forgetting is that X's job which he looooves to brag about pays him like nine dollars an hour USD. So $250 (on the high end of your prediction) would be quite a windfall for everyone's favorite Frenchy.
And X, my dear. For someone who claims to dislike us filthy Americans, you're acting decidedly American in your threats of a ridiculous and frivilous lawsuit. Congratulations.

I'd imagine you make probably 10 USD an hour. Something around minimum wage.
Canada now allows lawyers to work on a contingency basis. In other words you can hire a lawyer without having to pay upfront. In the event that you win the lawsuit or reach an out of court settlement the law firm would receive a percentage of the settlement, I think between 20-45% depending on when the case is settled. Of course the firm won't take the case if they don't think they can get a settlement or win. Also the courts may decide to throw the suit out, Canadian courts have shown they don't much tolerance for nuisance law suits.
