View Full Version : Does this count as a hit and run?

So basically my friend and her friend Amanda are out driving. Amanda is the driver and swerves to miss hitting a car that's turning and then she hits another car. Neither of them get out, my friend peers out the window to look for a dent. The other driver gets out to look at his own car. Then Amanda drives away.
Is that a hit and run? Or like leaving the scene of an accident?

Is only not a hit and run, if they both get out of the car, and fully inspect the collision area where both sides agree that there's no damage.
Though if the "victim" despite no damage asks for ID and writes down your license plate... do the same and write down theirs...
... and beat them to the police station to file a police report.
Even if only to say that there were no damage to the cars.

Re-read it.. sounds like he didn't give any inclination that it was ok to leave, so yes, that is technically a hit and run.

That's definately a hit and run. The original two cars were in no collision thus no accident, but the car your friend hit *was* the accident. The original car could have gotten a reckless driving fine and tagged for teh fault for insurance concerns, but her leaving messes that situation up.
Why was your friend swerving to avoid the first car?
And was their damage on the car she hit, and what kind of car was it?
And really, why did she run? No insurance?
Sounds like she may be in for some trouble, last question was it night or day?

When i was a kid i was racing my friend. When the light turned green he gunned it and a frigging semi hit his ass end and missed me completely(im slow). My friend with no insurance drove off very fast and i circled the block and saw the semi parked on the side of the road. It accured to me that maybe my friend was injured and was rushing to the hospital and i should stop and give the semi driver his info. Lol luckily i didnt do that or my friend would have been pissed off forever.
And yes thats definately a hit and run Leloo,be glad you wernt in the car. Thats the kind of trouble that your parents will bring up over and over and over again.

Yes.
May I ask what the hell she was thinking?

She basically wasn't looking and began to go, not noticing this car that was turning. So to miss that car she swerved at hit another. I just asked her and it was a mustang they hit during the day. And they didn't see any damage but remember, neither of them left the car.

If there's any damage, I'm sure your friend can expect a phone call...or a visit.
Definitely a bad move on her part. ALWAYS go out and speak with the person atleast if something happens...always.

<<She basically wasn't looking and began to go>>
Being in a car when that happens sucks. Scared the hell out of me. She really shouldn't have left, though.

Leloo, simple rule.....NEVER EVER EVER leave the scene of an accident without calling a police officer to take a report.
Even if there was very limited damage....have the police officer say that in their report. It really is your only defense against someone claiming you did more than you did, and or claiming you fled the scene.
I mean if it was your nextdoor neighbor you have known since birth....mayyyyyyyybe then you can do the pay on the side deal, but even then, money can make people do things you would never have thought them capable of.

I so agree about always calling the police. Because we were actually taught in our class that sometimes people will try to put the blame on you because you're young when it may not be your fault at all (especially senior citizens, he said)

On the subject of accidents and CYA:
I have one of those disposable cameras in my glove compartment. They're cheap so it's no big deal to buy one and if you're ever in an accident you have a way to verify all damage to the other's car and person so they don't inflate it and try to screw you over. They can also be used to take a picture of a car driving away and the license plate.

Oh my yes.
I was hit by this sweet little old lady in a nearby town soon after i bought my car. She pulled right across two lanes of traffic and just was not looking and drove right into the front drivers quarter panel of my car.
I called the police and before he arrived the ambulance did, someone else called it seems. The ambulance crew were old friends with this lady and they start hugging and its old home day. The police officer arrives and also knows this lady who it seems is the most popular senior citizen in town and the church organist . If the police had not been there, and i had not had a dozen witnesses i'm sure I would never have been believed over her. Even with that I had to press to make sure he wrote that she had been at fault.
It all worked out....but...it just crystalized for me the need to always protect yourself in such situations.
With just reading the original post, YES a definite hit and run.

if you are smart you'll leave the cars where they are and wait for the police to show up, but yea, nice job breaking the law.

Your friend better hope the guy she hit didnt get her license plate number. But then again, it would teach her a valuable lesson if he did.
Hit and run is a class A misdomeaner (sp?).... that carries a maxium sentence of 90 days in jail I think. Food for thought next time you wanna run from an accident.

Didn't give an exact penalty...
Punishments can range from a suspended sentence or fines, to serious jail time. In addition, persons convicted of a hit and run may have their drivers' licenses suspended, and may lose their vehicle.

Yes and Yes. I went on a high speed chase with this car that bumped into me when I was driving my ex's mustang. Then we hit the red light and I kicked her car door causing a dent. Stupid bitch.
Edited to say, there was no dent in the mustang, but it's the point where she should've checked anyway. She looked and then sped off, ugh I hate people.
