Just wondering is having 10 spells before lvl 40 a good idea as a rogue, BUT was wondering how many ranks of HP should I need for this to even be effective. I know Futtilo (spellcheck?) was thw+spells. I was wondering about ambushing with a thw.. BUT my current AS is 313 with my +50 from my bow/arrow and CoL signs, and I like that some things don't have a high ranged DS. I just don't want to switch and have to hack at things for an hour when I'm hunting. I like one shot one kill hunting.

Any advice, or concerns?

getting spells means sacrificing armor, usually. I wouldn't advise that unless you REALLY know what you're doing. Otherwise, you're making yourself weaker. It's way more cost effective to train to use magic items (and scrolls) than it is to learn the spells. E-wave isn't worth it that low in level. You get knockdowns as a rogue, including AMBUSH LEG. E-wave is barely worth it at cap considering I'd prefer heavier armor for the CvA. Futtilo, if I'm not mistaken, doesn't do any locksmithing.

Ambushing with a THW and ewave is awesome. My rogue set up this way probably has more kills per shot than my ranged rogue. That probably has to do with sometimes running into things in plate class with a bow. But really, any time you ambush from hiding with a maul and it meets head/neck, it's fatal. I had a lot of fun around that level with ewave with a THW build.

EDIT: And yeah, for THW + 410 builds, I don't see the spare points for locksmithing.

You're probably going to want a little more HP. Minimum mana I'd shoot for is probably about 45 with 60 being really comfortable.

Are your CM ranks based on some cmans you really want or are you just throwing points you see as spare? If it's the latter, I'd drop to 1x and bump up perception to 2x for maximum ranged AS, personally.

Are you in an area that requires swimming? If not, drop it.

What armor are you planning on being in? I'd say that for now you might want to take 50 ranks, get 2 ranks of armored evasion and wear chain shirt. The next goal would be 90 ranks (3 ranks armored evasion, MnE penalties at a minimum in Aug chain), then 100 ranks (3 point reduction in AP in aug chain from over-training).

Basically, I'd fixskill to this:
Ranks Skill Name
50 80 Armor Use (-30 from your current)
80 80 Ranged Weapons
46 80 Combat Maneuvers
80 80 Ambush
45 80 Physical Fitness
80 120 Dodging (-15 from your current)
11 40 Harness Power
20 80 Climbing
14 80 Swimming
80 120 Stalking & Hiding
65 120 Perception

Current Spell Next Spell
10 40 Elemental Wave Elemental Blade

Then decide what you need more of. If you need heavier armor now, put the ranks there, if you need more HP, start there. As-is it's a pretty workable build with spare points to fill in the gaps that you find once you've actually tried it out. I tend to fixskill into "least common denominator" builds with spare points and then build into one of the 2-3 forks that I'm debating over.
