Good article on espn.com about Title IX.

Blurb

Case in point: the federal judge's 95-page ruling on whether competitive cheerleading counts as a sport for Title IX purposes. It does not, the judge found, and thereby ordered Quinnipiac University in Hamden, Conn., not to disband its women's volleyball team. The school had planned to stop competing in women's volleyball as part of a budget cut while adding competitive cheer to broaden its appeal to potential enrollees. Adding cheer at a time when there is rising public interest in cheer sounds like a simple marketing decision on the college's part. To the judge, it was trampling an entitlement.

I fail to see how Cheer is not a competitive sport, particularly considering that the university is correct on the interest-level (ie "Cheerleader Nation" and such shows on TV), particularly compared to "sports" like badminton. Cheer probably has a higher overall activity level than baseball, honestly, with the majority of the time being spent standing around in the later.

I think the distinction here is that its not a sport under the ruleset for Title IX.

There is a 0% chance that Easterbrook actually read the 95 page decision before shooting off at the mouth. It is a pdf though, so I'll give him half a pass this time.

Most of the Quinnipiac ladies look like what I'd what I would expect in a cheerleader-provoked fap session. So I think, for them, if all their fine young women are already cheerleaders, then it inherently defeats the purpose of being a cheerleader when you're already a cheerleader.

I suspect that this so-called "federal judge" is probably driven by the motives of jealousy and envy. And is probably either a lesbian and/or has an overweight wife.

chuckle....no appeal? This is just some district court judge...lets see what the big boys in the CoA have to say about this, if QU decides to appeal.
