That game don't exactly sound like a big money maker.

At least it's being picked up. As long as they pay for the license, I don't think Simu cares at all. Look what happened to Too Human with the Unreal engine. That game was an epic flop (10 years of dev, 200k copies sold), and they blamed Epic. I seriously doubt Epic is hurting over the pending lawsuit.
This is also good news for any former HJ devs.
