Basically I got robbed.
I sold my boat 2 1/2 years ago and have never been paid. I can't find him or the boat. I still have the title and registration etc and a bill of sale.
If I find it can I just wtf go up and tow it away?
*Oh I've never received a cent since the first down payment from this fucker either.

If you still have the title, it's your boat. Now, I don't know how you could (safely) get it back, but I don't think the other person will have recourse should you demand it returned and take it via legal means.
I'd be concerned about laches, which basically is an assertion that you slept on your rights. For instance if he sold the boat already or has improved/repaired it he might be able to claim that, especially if he has some excuse to show that he attempted to pay for it, or he thought it was paid for.

I haven't slept on my rights I've actively tried to be in contact with this fucker and the one time I did run into him he was talking about buying another boat from someone... he didn't know I was standing behind him.

What state? Go to a nearby law school, or bar association and they should have a library. Look up statute of limitations (for contracts), and come back to us. If its passed, you're SOL

also, try finding him with www.zabasearch.com, or just googling him. You know where he works? It might help to call up the boat registration agency, see if the boat has been registered under his name, address, etc.

I've checked for the registration it hasn't been touched. The boat is just sitting somewhere hiding.
He's a private plumber so obviously his work changes day to day and he has moved and his wife changed jobs since.
My question is as was previously suggested... if I find it can I just pull up and hitch it and get the fuck out legally?

i dont recommend finding the boat and hitching it. Probably best to find him and then take to small claims court. It will take longer, but it is the safer route.
If you find the boat and just take it, he could call the cops, and depending who they believe, you could end up in the slam, then you'd have to buy a lawyer, etc etc...it could work, but small claims is the best place to go i think.

For the record, statute of limitations is generally no less than 2 years for oral contracts and no less than 4 years for written contracts. And you can't legally sell a boat without a written contract if it's over $5,000.

I was digging my contacts on the phone at the same time if it really matters. I came up with nothing. And I'm fairly networked.

I wasnt for sure since Google Maps was not pinpointing the address very closely. That and I stopped after isolating the first boat I saw that matched the description.
Either way, glad you're going to get it back. :)
