in gs3 I used to be able to be invisible and sign of darkness if I wanted to, I just did and got punished for an hour.... wtf

You definitely couldn't use it hidden/invisible in GSIII.

If you got lucky in the past and the people had left the room, or the room was full of Col'ers then you wouldn't get caught by it.
However the sign of darkness opens up this big ugly black void and sucks you in. It knocked you out of hiding for sure.

The second you use darkness, even in GS3 you would come out of hiding/inviso and the black flame would envelope you. If someone was in the room and wasn't a COL'er you got punished no way around it.

Perhaps you are thinking of Swords/Shields dropping while low on spirit? Inviso helps there.
