I just wanted to garner the law minded people to this thread with that title but a class action suit against SIMU doesn't really seem like that bad of an idea. Hmm....
Anyways.
The recent scientology thread brought to mind this story.
I'll break it down.
I was injured on the job installing a few TB storage server (alone) into a rack. Basically the fucker weighs a ton and it slipped/dropped whilst attempting to install it and I fucked up my back trying to keep it from breaking the paper thin server installed lower on the rack. Not the spine/discs or anything like that. It was a muscle.. from what the ER said it was the rhomboid.
Anyways the owner whom is a scieno strongly suggested (refused) that I seek medical care through normal means such as workman's comp etc. I ended up being forced to an alternative eastern medicine clinic (scieno husband's clinic) for free or find another job.
Acupuncture and massage and all that sort kind of thing. Now I'm not going to lie it was fucking awesome for immediate relief and I'll use it in the future without a doubt. However.. my fucking torn back muscle is still fucked the fuck up and giving me pain almost daily.
It's my opinion that I needed surgery to repair it or??? Anyways sometimes I feel like can't even fucking breathe as it causes basically my entire chest front and back to seize/cramp up.
Wrapping it up. Do I have any legal recourse having been basically forced not to use go the WC route and made to use "alternative medicine".
I would go have your injury assessed by a qualified physician to learn the extent of the damage and then evaluate whether or not to go after the person contracting your labor.
You could file a claim against his property insurance, there's usually a premises umbrella for injury (this is what most slip and fall cases go after) to persons. My advice would be to wait until you get paid for the job first. ;)
Make sure at the minimum you document everything... times, dates, what happend before, during, and post injury - including his insistance of using a non-standard medical service that he has a direct interest in.
I would imagine a PI attorney would take your case - but probably not pro-bono. So be prepared to put up a retainer fee.

In the state of texas you have up to 2 years to file a suit for personal injury.
Its never too late to start documenting and gathering supporting paperwork/evidence. You just have to be sure you're memory is intact.

That and I'm pissed at the place recently. The human resource cunt (that I gave the position to) is being a bitter bitch and I think she's giving out false/bad referrals. Which is another issue I need to think about.
I had recently contacted my old superior and asked for a new letter of rec after having going through HR to get it and he told me he's never heard of the request and gave it to me immediately. Leads me to believe this twat is sabotaging.

Most PI lawyers will work on a contingency basis, if they think your case is worth enough. IE, they only get paid if you win, and then they take a certain percentage off the top, which is usually ridiculously high, like filing fees + 30%.
As for the legal aspects, a few questions: You were contracted to this scientologist? Was it through some sort of service, or were you an independent contractor?
Did they specifically threaten you with loss-of-employment if you went to a traditional doctor (who would have given you workman's comp), because of their specific belief? It would have to be very clear how they worded this part. "Go to the alternative therapist, otherwise you're fired," would be vastly different from "We're scientologists, and we believe you should go seek alternative medicine.."
I don't know how workman's comp works in FL, but up here it's a strict bar on other litigation - IE, if you get workman's comp, you are barred from suing for other damages related to the injury. In fact, that might be a federal program, so I think it'd probably apply down there too, if it is. So it might be a good thing that you didn't get it.
You need a labor lawyer, now that I think of it, one welled versed in employers blackmailing employees. Any labor lawyer of that ilk'll be able to handle the PI part.

Hmm... How do I go about getting evidence??? Suggestions? I guess I could look up a witness who gave me a ride to the ER and the ER paperwork.
I don't have any paperwork from the alternative med place as it was all just walk in the door smile and get my shit done.

Get a back specialist to diagnose what's specifically wrong with you. Save ALL paperwork. Proving you worked that day and got injured on that day also shouldn't be too hard (depends on the company I guess). Write down everytime you're in pain, everytime you spoke to a doctor or lawyer. Write it down now so you don't forget the details later.
My mother has herniated disks from two car accidents that weren't her fault. I swear to god, she has 4 huge (3'x5'x2') tupperware containers FULL of notes and paperwork she saved knowing she would need it in the future. She won a shit ton of money (even though she probably spent double that amount and her quality of life is greatly decreased).
My #1 tip. Research any attorney you are thinking about using, if you plan onn going that far. Most of the injury lawyers are blood sucking idiots.

You dont carry health insurance on yourself. So seeing a specialist and getting shit like an MRI done will be a nice chunk of out of pocket change for you.... amIrite?
