My girlfriend is trying to pick a topic to write a law review article on that will hopefully be published. She is sorta hitting a wall thinking of topics. Right now, her best thought is writing on the legality of Pharmacist's having the right to refuse to dispense Plan B even though it is now OTC. She isn't super thrilled about it. Anyone have anything else that might be worth researching and writing on in any field?

Is she on a topical Journal? Or is it the primary law school journal?

I could give her some really super interesting tax issues, depending on her interests.

Write about the making of corporations as individuals under the 14th amendment and therefore subject to due process, which arose out of Santa Clara County v. Southern Pacific Railroad, actually NEVER SAID THAT in the opinion. It was said during oral arguments, but never legally substantiated, and that dicta was used to lay the foundation for corporate thievery for the next, what, 175 years?

There are tons of interesting 14th amendment topics in re: to how the court protected substantive due process for businesses, but denied it for individual rights. Insane.

Barring that, tell her to write on Carhart and how it affects women's rights in modern society.

Honestly, if she writes on Carhart, she will probably NOT get published. Every journal in the country is gonna publish an article about that this year. You want to write about something that everyone else is NOT writing about.

Our ACS president tried to argue that the President has a constitutional carve out based on the War Powers Act to torture people if necessary, in Criminal Procedure the other day.

I'm suspect of the so-called progressiveness of said organization.

I'm in the Federalist Society for the parties on the old plantation.

I believe some of what they do, even if most of them are hypocrites.

I'm in the Federalist Society just to keep track of them. They're actually rather even handed here, and hold more debates where they ask us to argue the other side.
