Oh the absolutely terrible jokes that will come...
I see CNN is going with "Suit over pants"
Without reading further lets guess what we will hear:
"Taking the cleaners to the cleaners"?
"Sued the pants off them"
"Put a stain on their credit"

I'm sure there are more...

Our legal system is the terrible joke, allowing crap lawsuits like this to clog up the courts and worse yet, ruin businesses and lives at times.

This is one of the extremely rare instances where I agree with this administration on Torte reform.

I'd cap this at a pair of Polo shorts. At best. And then the shortless one with the gizzat, my nizzat.

You don't think they'll settle?

"I would have never thought it would have dragged on this long," she told ABC News. "I don't want to live here anymore. It's been so difficult. I just want to go home, go back to Korea."

First, Pearson demanded $1,150 for a new suit. Lawyers were hired, legal wrangling ensued and eventually the Chungs offered Pearson $3,000 in compensation.

No dice.

Then they offered him $4,600.

No dice.

Finally, they offered $12,000 for the missing gray trousers with the red and blue stripes.

Pearson said no.

He also wants $500,000 in emotional damages and $542, 500 in legal fees, even though he is representing himself in court.

Ironically, less than a week after Pearson dropped off the missing trousers in 2005, Soo Chung found them, she says. She tried to return them to Pearson but he said they were the wrong pants.
...
He also said the receipt tag on the pants "exactly matches the receipt that Mr. Pearson has."

Dude is fucked up... just reaming them as hard and long as he can.

I think the real question that needs to be asked is if the Asian invasion here on the homesoil is being secretly initiated through imbedded Korean and/or Chinese dry cleaning highly-trained espionage specialists in all manners of clothes shops.

Seriously, they barred white people from the dry cleaning industry. Not that I have any problem with that, because most of the all-Asian dry cleaning buffets I've had my phat threadz playa'd out at were way more astute than those honkey bastard pantfolding bitches.

He says in court papers that he has endured "mental suffering, inconvenience and discomfort."

Over a pair of trousers?
Hardly the kind of "professional" you would want involved in a complex court hearing.

Judge Judy needs to hear this case.

I hope a judge eats the guy alive in court. Especialy inlight of the multiple attempts to settle and the production of the supposedly missing trousers by the cleaners when they were found. He should be made to pay all court costs of the cleaners if/when he loses.

I didn't actually read the link, so my apologies.

That's pretty retarded of the lawyer. Maybe he needs to go re-read the Federal Rules of Civil Procedure, particularly 11(b).

Keller

There is pretty settled precedent on severe punative measures under 11c for suits like this.

Don't remember the name, but some chick sued Mattel saying she invented "College Cheerleader Barbie" or whatever, first. There was tape of a deposition in which her lawyer's were shown the copyright for the Barbie which pre-dated the the time she claimed to have invented the doll. The lawyer proceeded to refuse to look at the papers and continued in the lawsuit.

Assuming the receipt is legitimate (authentication issues under federal rules of evidence) and the dry-cleaner can prove she showed it to the dude, then I'd assume he's going to be paying a heavy fine for this suit.

Thats good news. I hope we see press coverage if the guy faces some serious sanctions for bringing this BS to court.

The dry cleaners should get some compensation for this asshole bringing this suit against them. I'm talking in the half million dollar range.

Maybe that will stop douche bags like this from suing people over a fucking pair of fucking pants.

Tolwynn
05-04-2007, 10:37 AM
If they really wanted to teach a lesson, they'd slap him with punitive fines and then disbar the douche for good measure.

Exactly. Disbar the fucking lawyer who brought this bullshit suit to court. ANYONE with a fucking ounce of common sense can see this is a frivolous lawsuit.. and someone who is able to legally practice law who can't, should surrender their law degree so that it may line a gerbil cage, because that is what it is worth.

Drinin

People who file these frivolous lawsuits should be charged and thrown in jail for wasting the court's time.

Yep, being offered more than ten times the value of the suit in a settlement and not taking it. . . Stupid.

Speaking from experience, I've had several items wind up 'missing' from the cleaners. Each time a piece count is taken and compared with the ticket prior to leaving the store, by myself at the same time its being done by the cleaner employee. If the count is off, then they do a search on the racks. If it cant be found, they reimburse me for the cost of a replacement, I just bring them a receipt of a new like item. Its that easy, and you dont have to be a dick when something comes up missing.

On the cleaners end, if they give you shit for losing an item (some cleaners outsource some aspects of dry cleaning/laundering to other cleaning plants), then you need to find a better quality cleaners.

My cleaners is owned by a family who knows my name when I walk in the door, they are friendly, and I've been going there so long I've watched their children grow up and now attend college. I wouldnt dream of being an ass to them even if they lost the whole set of suits I take each week. Shit happens, learn to deal with it and move on. Life's too short to act like this guy's doing.

The best part is this guy (who brought this suit) is not only a lawyer, but a JUDGE.

It seems a little odd to me, that while the Dickhead was ordered to pay costs, that didnt extend to the Legal fees of their attorney. I would have thought that would be an automatic assumption, given the fact that they wouldnt have needed to hire an attorney if he hadnt taken them to Court on such a stupid claim.

It's kinda sweet that there is some common sense in the US Courts though.

They're going after attorney fees next.

A motion to recover the Chungs' tens of thousands of dollars in attorney fees will be considered later.

They seriously need to have the judge pay the attorney's fees as well, or there's not going to be much to keep jackasses like him from continuing to try to strongarm frivolous lawsuits through the court system.

You've become as predictable as Jesse Jackson and Rev. Al. Everytime something is posted that involves a black individual we can count on you to chime in with a Jesse or Al comment.

On a semi-related note, the dry-cleaners near my place lost my shirt last week, you should have seen the poor woman panicking. She didn't speak much English so I was trying to tell her not to worry about it, but I guess since I live next to DC she was afraid I'd bring a lawsuit like that asshat did.

IT'S FINALLY HAPPENED. Roy Pearson, the administrative law judge, pictured above, who sued a dry cleaners for $54 million over a lost pair of pants, lost his job Tuesday and was told to clear out his office, sources tell The Post.

However, sources say that the pants lawsuit, which spawned headlines around the world, didn't have much to do with the decision not to reappoint Pearson, Keith L. Alexander reports:

Pearson, 57, who had served as a judge for two years, was up for a 10-year term at the Office of Administrative Hearings, but a judicial committee last week voted against reappointing him. ...

[T]he committee said it had reviewed Pearson's judicial decisions and audiotapes of proceedings over which he had presided, and found he did not demonstrate "appropriate judgment and judicial temperament," according a source who spoke on condition of anonymity because of the sensitive nature of the case.

Pearson was informed of the decision in a seven-page letter that was hand-delivered to him at about 3:30 p.m., Alexander reports. The letter told Pearson to vacate his office by 5 p.m.

Pearson's lawsuit against Custom Cleaners of Northwest D.C. eventually ended with a U.S. District Judge finding for the defendants. Pearson later indicated that he would appeal.

While it was well deserved, it comes as too little too late.

They didn't have the balls to do it before his term came to an end and settled for not giving him a reappointment to the bench.
