Man, I've made an absolute KILLING in Apple (AAPL) stock over the past 6 years. It sucked to own it at the beginning, but I'm glad I kept it. I just bought a bunch more the day after the market 'correction' and have been pleased. I can't wait for them to release the i-Phone (or whatever they are going to call it) and can only hope it does what the iPod did for the stock price.

The Securities and Exchange Commission is this week expected to file civil fraud charges against Apple (http://mwprices.ft.com/custom/ft2-com/html-quotechartnews.asp?FTSite=FTCOM&q=AAPL&searchtype&expanded=&countrycode=us&s2=us&symb=AAPL&company=NEW)’s former top lawyer about stock options backdating. The decision would be the first legal action in a case that raises questions about the role played in improper options-granting practices by Steve Jobs, Apple’s chief executive.

The SEC is expected to claim that Nancy Heinen, who resigned as Apple’s general counsel last year, engaged in a scheme to defraud investors by changing grant dates of stock options to inflate value, people familiar with the matter said yesterday.


Lawyers for Ms Heinen said she would fight any charges.

“Nancy did not participate in moving grant dates back in time or to a lower price,” said Cristina Arguedas, one of Ms Heinen’s attorneys. “We think we have a very strong defence and we are fighting the case.”

Apple is the highest-profile company to have been caught up in the scandal about options backdating, a practice where the grant dates of stock options are changed with hindsight to inflate their value. More than 200 companies have come under scrutiny in regard to the practice.

Dozens of senior executives have been forced to resign. Several have faced civil or criminal charges. The SEC is locked in an internal debate about whether to charge companies over the practice.

Questions about Mr Jobs’s role in backdating at Apple have been posed since June, when Apple declared it had found “irregularities” in timing of options grants, including one grant to Mr Jobs.

In October, Apple said an investigation cleared Mr Jobs of any wrongdoing. The investigation uncovered “serious concerns regarding two former officers in connection with the accounting, recording and reporting of stock option grants”. Those two are believed to be Ms Heinen and Fred Anderson, former chief financial officer. Mr Anderson could not be reached to comment.

It emerged in December Mr Jobs had personally recommended some instances of backdating. Apple said Mr Jobs had recommended favourable grant dates, but did not benefit and was unaware of the implications.

The case against Ms Heinen is expected to concern a grant of 7.5m options to Mr Jobs in December 2001 and a January 2001 grant to several executives. The second grant, approved by Mr Jobs, resulted in 400,000 stock options to Ms Heinen, a person familiar with the matter said.

Apple's iPhone kind of reminds me of the PS3. It does lots of stuff, it has dedicated fanboys and it's got a price that firmly sets in the luxury items category.

Hopefully it won't flop like the PS3.

Yeah the iPhone is nothing revolutionary, the only thing it has that sets it apart is it has multi-touch... which is a fucking waste on a cell phone. Basically a normal phone (Palm, Windows Mobile, Blackberry) can only sense one touch or "click" at a time, the iPhone can sense two fingers at a time.

Thats whats funny about Steve Ballmer’s laughing. A full keyboard is nothing new and not something MS invented. Its reactionary talk.

Wozniak actually headed up the SideKick, which was revolutionary for its time. Blackberry has taken the lead on that but I can bet you the Blackberry is not as visually stunning, or accessible, as the SideKick.

Maybe people just want a cool phone when they are on the go and not have to be connected to every contact at all times.

I just bought my wife the Sony Walkman W810 phone with a 2GB expansion SDpro card and it rocks. Only thing I dont like is that the headphone jack is the same fitting as the power jack which is non-conventional (rather than a mini-plug for most headphones).

Having music on your phone is sweet. Having a phone that does everything is even sweeter (until it breaks :( ).

I've had that phone for around 6 months now, and it hasn't broken once. It does struggle with 2 GB's of data floating around however. And the battery tends to die very quickly if you're using the MP3 player. Otherwise it's a superb phone. I took the plunge and bought it so I didn't have to become one of those cocks with an iPod.

I hate my phone. I bought it around a yearish or so ago.. and I hate it.

If you ever want to buy the Pocket PC, refrain.

I hate the fact that the pencil thing fucking falls out all the time (I gave up after my 4th one of keeping it)

The expansion card pops up all the time. I can't believe I haven't lost it yet.

The camera fucking sucks ass.

You can't get email real time via MS Outlook.. if you want to send/receive emails, you have to have it in the cradle connected to your computer. Wow, thanks for the convenience.

I don't think the i-phone will be available through Sprint.. which means I won't get one.

That's silly - it's awesome, and I'd be lieing if I said I didn't want to buy one...but I'll wait for g2 or g3, when they have the hardware and software problems hammered out and the price is more reasonable.

I fail to see the hype of the iPhone. Yes it has a touch screen... Yes it has a hard drive... It's also overpriced, not 3g, and its huge. If... (note I said "if," not "when") Apple releases a version of the iPhone with 3g compatibility... I might see the point. But as a Smartphone... it's severely lacking. It's an iPod / Phone hybrid... thats it.

I care in the sense that it will quite likely make me money through the stock market. I wouldn't dream of buying one for a while. Think of first generation iPods.

Yea.. I couldn't give a rat's ass about the iPhone for myself.. but I know plenty of people who are on the list to get one as soon as they are released.

I'll probably sell my Apple stocks later on this year.. it's been by far the most profitable holdings I've ever owned.

I love AAPL. Indicators look good to me. I should buy Puts but im too chicken and I don't like the market reactions.

www.stockcharts.com is pretty informative if you want to learn some tech analysis.

Both.. and I'm hoping that this isn't the 'top'. I'm hoping the 'top' will be in about a month when the stock hopefully splits and climbs another time. Big market correction today, and it only lost $.90 I'm looking long and hoping the iPhone is half of what the iPod was.

Apple is not my most profitable holding ever.. it was a specific day that was.. since most of my actual holdings are in Hilton stock. Apple was just icing on the cake. The reason I purchased Apple when I did was I had a friend who worked for Apple and I liked the R&D information that I was hearing. iPod was huge... and I hope iPhone does just as well for the company.

By the way.. had you purchased AAPL the week I told you to, you would be enjoying a 50%+ return.

I started thinking about AAPL as it is taking a beating today, unfortunately. Did you ever get out of this?

I opted out in May or June when they announced the low price of the new iPhone. I sold the rest of my stock portfolio then as well and put it all into small certificates of deposit where it will likely stay until this mess is over. I wasn't nearly as smart with my 401k though... But at least I didn't contribute to it at all this year. Come next month, I'll put my years contributions into safer type investments and ride out this storm. I had planned on buying 1 more rental property this year, but I'll wait.
