I really want to know whether it's true that if a company sollicits a product over the telephone, has been overtly told to shut up, and you've tagged up a name and number, that you can file a police report and receive a cash claim for harassment.

Not that I support that kind of frivolous action as a means to an end financially, more of a stick to 'em mentality.

The problem with telling telemarketers to cease and desist, is that most of the time their company doesn't produce its own phone list. They usually buy them from companies like Dunn and Bradstreet or other marketing firms that compile the lists, and sell them to other companies. So the telemarketing company has no control over the names and numbers that show up on their lists, except to tell the marketing firms they want specific demographics (like a household with at least one adult between the age of 26-45 earning between 50k and 90k/year, or a small business with a single owner rather than a partnership or corporation, etc. etc. etc.)

I wish I could listen to the link, but I hooked up new speakers to the computer and can't find the blasted power cord for them. So - no sound til I get to the store and buy a new one.

From what I've read, I believe if you are on the do-not-call list, for every infraction of a telemarketer calling you, you can receive a cash award of $2500.

Uhm bullshit. They have complete control over the leads list and in fact is their responsibility to purge it against the do not call list before dialing. That's why there are SQL and DB professionals in that industry.

More of the problem is the same leads are sold to many outfits and when a person tells them to "take them off their list" they usually do.. at that outfit and the person is thinking they're off the "super" list or some shit.

If you provide any kind of information and click a button or check a box that says "I agree" 99% of the time you are opting out of your Do-Not-Call rights.

Once you provide a business with this information, they have every right in the world to call you as much as they want. Most will not call to the point of harassment b/c its not good business but they are some...

OMG!! So I take calls at home for a Teleservices company...INBOUND only. I swear this lady called in my line today, she was completly insane! I was put on a conference call with the supervisor, and of course she wasn't yelling at me. No matter how many times he told her there is no way for us to have called her on the number she called in on she wouldn't quit.

This is harassment, My mother is 87 years old, and I have cancer, and your calling me 6 times a day.. F-you..and give me someone on the phone with a brain. I'm calling the NY attorney general..etc. etc.
