2 Protesters Arrested After Going Topless

By Evan Halper, Times Staff Writer

SACRAMENTO — Police arrested two members of an organization called Breasts Not Bombs after they removed their tops during a protest on the steps of the state Capitol on Monday afternoon.

The women, who were protesting Gov. Arnold Schwarzenegger's ballot measures for today's special election, took off their shirts despite warnings from the California Highway Patrol last week that doing so would lead to their arrests — and possibly their inclusion on the state's list of sex offenders. A federal judge Friday refused to grant a request from Breasts Not Bombs to block the police from arresting topless protesters.

Officials at the Sacramento County district attorney's office said they have not decided whether to prosecute the protesters, and if they do, whether to seek to have them listed as sex offenders.

"We have done these demonstrations from San Francisco to Mendocino to the gates of the White House and never been restrained in this way," said Breasts Not Bombs member Sherry Glaser of Albion, Calif., near Mendocino, addressing about 100 onlookers.

Soon after, Glaser, 45, removed her top and was promptly arrested. Renee Love, 40, also of Albion, was arrested after she removed her top. Both were charged with indecent exposure, disorderly conduct and going beyond the scope of their permit to demonstrate on state property.

"The permit specifically said that nudity would not be allowed," said Tom Marshall, a CHP spokesman. "We're clearly following the law as it was written. They took us to court Friday seeking a restraining order to stop us from arresting them and the judge came down on our side."

Angered that Glaser and Love could be listed on the sex offender registry if convicted of lewd acts, state Sen. Gloria Romero (D-Los Angeles) joined the protesters before their arrests to announce that she would introduce legislation to decriminalize the baring of breasts in public. "While it is legal for men to go shirtless in public in California," she said, "women risk being classified as sex offenders for baring the same body parts."

Women going topless is generally a blessing.

While I am all about boobies.. what a stupid piece of legislation. Leave it to the libs... "IT'S NOT FAIR, MEN CAN GO TOPLESS WHY CAN'T WOMEN!"

Seems pretty logical to me.

That doesn't surprise me. "HE HAS IT, WHY CAN'T I" has been the centerpiece of the Democratic party for years.

Men and women are not now, nor have they ever been the same. To say they are is to deny the most important characteristic of humanity: individuality.

That being said, c'mon. Putting them on the sexual offender list dilutes the purpose of the list to pointlessness. I don't particularly want every 45-year-old broad walking around topless, but let's have some sense about this.

We had a similar case in Ontario, Canada a few years back. The main argument being that if men could go topless, woman should be allowed to as well. A bunch of feminazis were arrested for going topless. They argued in court that breast weren't a sexual part of the body and as such they should be able to go topless. They won their case and women in Ontario were allowed to go topless. Now you would think this would be a good thing for men but trust me it wasn't. Every nasty fat ugly woman would go topless while the quality women would cover their breasts.

About a year after that ruling a man was arrested for grabbing a woman's breast and charged with sexual assault. His lawyer argued that in Ontario the courts had decided that a woman's breast wasn't a sexual part of the body and as such his client hadn't committed sexual assault. I can't remember the initial ruling but it was appealed and appealed and in the end the courts decided that breasts are a sexual part of the body and women can't go topless.

Oh boy. Stupid generalizations from Parkbandit. My turn!

I think I should go with the standard conservative tactic on something like this. Men should be made sex offenders for walking around with their shirts off too. That'd be so very logical!

At the very least, guys'd be exposed to less man boobs, which for some reason I like lots less than girl boobs.

If you've ever been to the female portion of a gay pride march, there will always be those select few women that decide to bare their breasts for all to see at some point during the festivities. I've never witnessed an arrest when this happens. Though I think it is an idiotic thing to do in public. I'm all for feminists expressing their opinons, but have some common sense and decency about your actions.

Being made a sex offender because of said action when it correlates to a particular protest and not in the context of being sexually perverted is equally ridiculous.

With the exception of man breasts, aren't they different body parts? Is my social conditioning taking over here? I just feel like...men's chests are different, socially acceptable in limited settings. Women...not socially acceptable. Don't get me wrong, I love breasts, but uh...I dunno, just seems *wrong* to me.

Imagine if you were walking down the strip with yer dad (shirtless) and your mom (shirtless). I'd feel ridiculous.

[Some] mens breast's are not socially acceptable no matter what the setting. i.e. when they have more than the average woman up top. That can be downright scary. Other than that I agree that it's definitely not socially acceptable.

Is this really that big of an issue?

Who walks around shirtless in public anyway? Only time I see shirtless people is at the beach or pool. Occasionally a shirtless jogger. Nothing screams "trash" more than barefoot or shirtless in public.

I argue. A man's chest is the most attractive sexual thing about his body to me. Love the nips. Well, okay, I love everything, but the chest is definitely sexual to me. To say it isn't, is to ignore individuality just as much as saying a woman's breasts are sexual.

That said, you can't go against what the law says and not expect to be arrested if caught. You want to change the law? Fine. But until you change the law, you have to abide by the law. I agree with the arrest and charge of exposure, not with the pervert list thing. It just proves politics makes people do ridiculous things (on both sides).
